AN ACT CONCERNING THE RIGHT OF A FORMER OWNER OF REAL PROPERTY TO REPURCHASE THE REAL PROPERTY WHEN THE PROPERTY WAS TAKEN BY THE STATE THROUGH EMINENT DOMAIN.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That chapters 238 and 835 of the general statutes be amended to provide that when the state takes real property from a person through eminent domain and the real property is subsequently not used for the purpose for which it was taken, the state shall first offer the real property for sale to the person from whom the real property was acquired.

Statement of Purpose: 

To give a former owner of real property taken by the state through eminent domain the opportunity to buy back the real property when the property is not used by the state for the purpose for which it was taken.
