2424 AN ACT CONCERNING THE SALE OF PRIVATE LABEL ALCOHOLIC LIQUOR.

2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

2828 Section 1. Section 30-63 of the general statutes is amended by adding subsection (d) as follows (Effective from passage):

3030 (NEW) (d) No holder of a manufacturer or wholesaler permit shall discriminate in any manner on sales or purchases of any private label alcoholic liquor to any retail permittee. Such private label alcoholic liquor, if offered for sale or purchase by the holder of a manufacturer or wholesaler permit, shall be offered at the same price and in the same manner to each retail permittee or shall not be offered for sale or purchase in this state.

3232 Sec. 2. Section 30-64b of the general statutes is repealed and the following is substituted in lieu thereof (Effective from passage):

3434 The sale of any alcoholic liquor by a wholesale or retail permittee: (1) In violation of subsection (d) of section 30-63, as amended by this act, or (2) for off-premises consumption at a price the intent of which is to destroy or prevent competition with any other permittee holding a like permit, shall be deemed an unfair pricing practice. The Department of Consumer Protection may suspend or revoke any permit upon a finding of an unfair pricing practice. In arriving at such finding, the Department of Consumer Protection shall consider, but not be limited to, the consideration of the following factors: Labor, including salaries of executives and officers, rent, interest on borrowed capital, depreciation, selling cost, maintenance of equipment, delivery costs, credit losses, insurance and warehouse costs.
