Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective October 1, 2017) (a) No person who operates a retail establishment that sells groceries or employee of such establishment may purchase a gift certificate from a secondary market source. For purposes of this section, "gift certificate" means gift certificate as defined in section 3-56a of the general statutes, and "secondary market source" is a person who sells or resells a gift certificate obtained through the exchange of merchandise with a retail establishment without a receipt for proof of purchase of such merchandise. (b) Any person who violates the provisions of subsection (a) of this section shall be guilty of a class A misdemeanor. Sec. 2. (NEW) (Effective October 1, 2017) (a) No person who operates a retail establishment that sells groceries or employee of such establishment may sell or offer for sale at such establishment a gift certificate purchased in violation of section 1 of this act. (b) Any person who violates the provisions of subsection (a) of this section shall be guilty of a class E felony.
