24	24		RESOLUTION ENCOURAGING THE DONATION OF EXCESS FOOD TO NONPROFIT ORGANIZATIONS TO FEED FOOD-INSECURE INDIVIDUALS IN THE STATE.

26	26		Resolved by this Assembly:

28	28		WHEREAS, it is the intent of the Connecticut General Assembly to reduce food waste and to provide assistance to food-insecure individuals throughout the state; and

30	30		WHEREAS, Section 52-557l of the Connecticut General Statutes provides immunity from civil and criminal liability for good-faith donors of food to bona fide charitable or nonprofit organizations; and

32	32		WHEREAS, in 1996 the United States Congress passed the Bill Emerson Good Samaritan Food Donation Act, which protects good-faith donors from liability at the federal level; and

34	34		WHEREAS, the Bill Emerson Good Samaritan Food Donation Act protects individuals, corporations, partnerships, organizations, associations, government entities, wholesalers, retailers, restaurateurs, caterers, farmers, gleaners, nonprofit agencies, and others who donate food to nonprofit feeding programs; and

36	36		WHEREAS, the Bill Emerson Good Samaritan Food Donation Act protects food donors from civil and criminal liability and covers donation of all food and grocery products that meet quality and labeling standards imposed by federal, state and local laws and regulations, even though the food may not be "readily marketable due to age, freshness, grade, size, surplus, or other conditions"; and

38	38		WHEREAS, the Federal Food Donation Act of 2008 encourages executive agencies and contractors of executive agencies to donate excess food to food-insecure individuals and keep such food out of landfills; and

40	40		WHEREAS, donations of excess food for consumption by food-insecure individuals reduces greenhouse gas released in landfills which in turn reduces climate change; and

42		-	WHEREAS, there are numerous food-insecure families in Connecticut who experience ~~difficulty~~ obtaining affordable, nutritious food on a daily basis who would be helped by donation of excess food.

44	44		NOW THEREFORE BE IT RESOLVED, that the Connecticut General Assembly encourages all state agencies and their contractors to donate excess, wholesome food to nonprofit organizations that provide assistance to food-insecure individuals in the State of Connecticut.
