RESOLUTION PROPOSING AN AMENDMENT TO THE STATE CONSTITUTION TO PERMIT A JUDGE OF PROBATE WHO ATTAINS SEVENTY YEARS OF AGE WHILE HOLDING OFFICE TO COMPLETE HIS OR HER TERM OF OFFICE.
Resolved by this Assembly:
Section 1. That the following be proposed as an amendment to the Constitution of the State, which, when approved and adopted in the manner provided by the Constitution, shall, to all intents and purposes, become a part thereof:
Article eighth of the amendments to the Constitution is amended to read as follows:
No judge shall be eligible to hold his office after he shall arrive at the age of seventy years, except that (1) a chief justice or judge of the supreme court, a judge of the superior court, or a judge of the court of common pleas, who has attained the age of seventy years and has become a state referee may exercise, as shall be prescribed by law, the powers of the superior court or court of common pleas on matters referred to him as a state referee, and (2) a judge of probate who has attained the age of seventy years while holding office as judge of probate may continue to hold office until completion of the term of office.
RESOLVED: That the foregoing proposed amendment to the Constitution be continued to the next session of the General Assembly elected at the general election to be held on November 6, 2018, and published with the laws passed at the present session, or be presented to the electors at the general election to be held on November 6, 2018, whichever the case may be, according to article sixth of the amendments to the Constitution. The designation of said proposed amendment to be used on the ballots at such election shall be "Shall the Constitution of the State be amended to permit a judge of probate, who attains the age of seventy years while holding the office of judge of probate, to complete his or her term of office?"
