AN ACT CONCERNING INDEPENDENT EVALUATIONS AND THE BURDEN OF PROOF IN SPECIAL EDUCATION HEARINGS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That subdivision (1) of subsection (d) of section 10-76h of the general statutes be amended to shift the burden of proof in special education hearings to the party requesting the hearing when such party is seeking an independent evaluation and to require such party to pay for such independent evaluation.
Statement of Purpose:
To reduce special education mandates on school districts.
