1212 AN ACT PERMITTING A COMMUNITY SPOUSE OF AN INSTITUTIONALIZED SPOUSE TO RETAIN THE MAXIMUM AMOUNT OF ALLOWABLE ASSETS.

1616 Section 1. (NEW) (Effective from passage) (a) For purposes of this section:

1818 (1) "Institutionalized spouse" has the same meaning as provided in 42 USC 1396r-5(h)(1).

2020 (2) "Community spouse" has the same meaning as provided in 42 USC 1396r-5(h)(2).

2222 (b) The Commissioner of Social Services shall amend the Medicaid state plan to permit the community spouse of an institutionalized spouse to retain the maximum community spouse resource allowance pursuant to 42 USC 1396r-5(f)(2).

2424 (c) The commissioner shall adopt regulations, in accordance with the provisions of chapter 54 of the general statutes, to implement the provisions of this section.
