2424 AN ACT CONCERNING RIGHT-SIZING, REBALANCING AND REPURPOSING NURSING FACILITIES FOR THE TWENTY-FIRST CENTURY.

2828 Section 1. Subsection (a) of section 17b-340d of the general statutes is repealed and the following is substituted in lieu thereof (Effective July 1, 2017):

3030 (a) The Commissioner of Social Services [may implement] shall develop an acuity-based methodology for Medicaid reimbursement of nursing home services. In the course of developing such a system, the commissioner shall review the skilled nursing facility prospective payment system developed by the Centers for Medicare and Medicaid Services, as well as other methodologies used nationally, and shall consider recommendations from the nursing home industry. The commissioner shall implement the acuity-based methodology for Medicaid reimbursement in phases commencing on and after July 1, 2019.

3232 Sec. 2. (NEW) (Effective July 1, 2017) Notwithstanding any provision of the general statutes, the Commissioners of Social Services and Developmental Services may contract with a nursing home provider for the establishment of services and supports for individuals who (1) require the level of care provided in a nursing home, and (2) are eligible to receive services from the Department of Developmental Services. The establishment of such services and supports shall not be subject to the provisions of sections 17b-352 to 17b-354, inclusive, of the general statutes. For purposes of this section, "nursing home" has the same meaning as provided in section 19a-490 of the general statutes.

3434 Sec. 3. Subsection (b) of section 17b-352 of the general statutes is repealed and the following is substituted in lieu thereof (Effective July 1, 2017):

3636 (b) Any facility which intends to (1) transfer all or part of its ownership or control prior to being initially licensed; (2) introduce any additional function or service into its program of care or expand an existing function or service; or (3) terminate a service or decrease substantially its total bed capacity, except for a voluntary reduction of beds in accordance with section 4 of this act, shall submit a complete request for permission to implement such transfer, addition, expansion, increase, termination or decrease with such information as the department requires to the Department of Social Services, provided no permission or request for permission to close a facility is required when a facility in receivership is closed by order of the Superior Court pursuant to section 19a-545. The Office of the Long-Term Care Ombudsman pursuant to section 17a-405 shall be notified by the facility of any proposed actions pursuant to this subsection at the same time the request for permission is submitted to the department and when a facility in receivership is closed by order of the Superior Court pursuant to section 19a-545.

3838 Sec. 4. (NEW) (Effective July 1, 2017) Notwithstanding the provisions of section 17b-352 of the general statutes, a nursing home facility, as defined in section 19a-490 of the general statutes, may voluntarily decrease its total licensed bed capacity by way of a temporary reduction of licensed beds while maintaining its right to place such beds back into service.
