2424 AN ACT CONCERNING DISPARITIES IN THE HEALTH CARE SYSTEM.

2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

2828 Section 1. (NEW) (Effective from passage) (a) On or before January 1, 2020, any state agency, board or commission that directly, or by contract with another entity, collects demographic data concerning the ancestry or ethnic origin, ethnicity, race or primary language of residents of the state in the context of health care or for the provision or receipt of health care services or for any public health purpose shall:

3030 (1) Collect such data in a uniform manner that allows for aggregation and disaggregation of data across agencies, boards and commissions;

3232 (2) Expand race and ethnic categories of Asian, African-American, Hispanic, regardless of race, and Native Hawaiian and other Pacific islander to include subgroup identities present in the state;

3434 (3) Provide the option to individuals of selecting one or more ethnic or racial designations;

3636 (4) Ensure in cases where data concerning an individual's ethnic origin, ethnicity or race is reported to any other state agency, board or commission that such data is neither tabulated nor reported without all of the following information:

3838 (A) The number or percentage of individuals who identify with each ethnic or racial designation as their sole ethnic or racial designation and not in combination with any other ethnic or racial designation;

4040 (B) The number or percentage of individuals who identify with each ethnic or racial designation, whether as their sole ethnic or racial designation or in combination with other ethnic or racial designations; and

4242 (C) The number or percentage of individuals who identify with multiple ethnic or racial designations.

4444 (b) Notwithstanding any other provision of this section, any state agency, board or commission that collects demographic data from a local agency may continue to collect and report such data to any other state agency, board or commission in the form in which the local agency submits such data.

4646 (c) Notwithstanding any other provision of this section, any state agency, board or commission that collects ethnic or racial data solely to comply with federal requirements may continue to collect and report such data to any other state agency, board or commission in the form required by the federal government.

4848 (d) On or before July 1, 2020, and annually thereafter, each state agency, board or commission that collects demographic data pursuant to this section shall report such data to the federal Office of Personnel Management.

5050 (e) No state agency, board or commission shall report demographic data under this section in a manner that would permit identification of any individuals. A state agency, board or commission may aggregate data categories at a state, county, city, census tract or zip code level to prevent the identification of any individuals.

5252 (f) On or before January 1, 2019, any agency, board or commission described in subsection (a) of this section shall develop a plan to implement the provisions of this section. Each such agency, board and commission shall report, in accordance with provisions of section 11-4a of the general statutes, to the joint standing committee of the General Assembly having cognizance of matters relating to public health regarding such plan.
