LCO No. 4698 1 of 2 General Assembly Committee Bill No. 5142 January Session, 2019 LCO No. 4698 Referred to Committee on PUBLIC HEALTH Introduced by: (PH) AN ACT PROHIBITING FEMALE GENITAL MUTILATION. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective October 1, 2019) (a) Except as provided in 1 subsection (b) of this section, a person is guilty of performing female 2 genital mutilation when such person knowingly circumcises, excises or 3 infibulates the whole or any part of the labia majora or labia minora or 4 clitoris of a person under the age of eighteen. 5 (b) A surgical operation is not a violation of subsection (a) of this 6 section if such operation is (1) necessary to the health of the person on 7 whom it is performed, as determined by a physician licensed pursuant 8 to chapter 370 of the general statutes, and performed by a physician 9 licensed pursuant to said chapter; or (2) performed on a person in 10 labor or who has just given birth, for medical purposes related to such 11 labor or birth, by a physician licensed pursuant to chapter 370 of the 12 general statutes, a nurse-midwife licensed pursuant to chapter 377 of 13 the general statutes or a person in training to become such a physician 14 or nurse-midwife. A surgical operation is not necessary to the health of 15 the person on whom it is performed if the basis for such necessity is 16 Committee Bill No. 5142 LCO No. 4698 2 of 2 the belief of such person or any other person that such operation is 17 required as a matter of custom or ritual. 18 (c) Performing female genital mutilation is a class D felony. 19 This act shall take effect as follows and shall amend the following sections: Section 1 October 1, 2019 New section Statement of Purpose: To establish the crime of mutilation of female genitalia of minors as a class D felony.
