1831 AN ACT EXCLUDING PERSONS CONVICTED OF CERTAIN SERIOUS
1932 FELONIES FROM THE EARNED RISK REDUCTION CREDIT

2134 Be it enacted by the Senate and House of Representatives in General
2235 Assembly convened:

24-Section 1. Subsection (a) of section 18-98e of the general statutes is 1
25-repealed and the following is substituted in lieu thereof (Effective 2
26-October 1, 2019): 3
27-(a) (1) Notwithstanding any provision of the general statutes, any 4
28-person sentenced to a term of imprisonment for a crime committed on 5
29-or after October 1, 1994, and committed to the custody of the 6
30-Commissioner of Correction on or after said date, except a person who 7
31-is sentenced for a violation of section 53a-54a, 53a-54b, 53a-54c, 53a-8
32-54d, 53a-55, 53a-55a, 53a-70a, 53a-70c or 53a-100aa, or is a persistent 9
33-dangerous felony offender or persistent dangerous sexual offender 10
34-pursuant to section 53a-40, may be eligible to earn risk reduction credit 11
35-toward a reduction of such person's sentence, in an amount not to 12
36-exceed five days per month, at the discretion of the Commissioner of 13
37-Correction for conduct as provided in subsection (b) of this section 14
38-occurring on or after April 1, 2006. 15

37+That section 18-98e of the general statutes be amended to prohibit 1
38+any person convicted of one or more of the following crimes from 2
39+earning risk reduction credit toward a reduction in such person's 3
40+sentence: (1) Manslaughter in the first degree under section 53a-55 of 4
41+the general statutes, (2) manslaughter in the first degree with a firearm 5
42+under section 53a-55a of the general statutes, (3) assault in the first 6
43+degree under section 53a-59 of the general statutes, (4) assault of an 7
44+elderly, blind, disabled or pregnant person or a person with 8
45+intellectual disability in the first degree under section 53a-59a of the 9
46+general statutes, (5) assault of a pregnant woman resulting in 10
47+termination of pregnancy under section 53a-59c of the general statutes, 11
48+(6) sexual assault in the first degree under section 53a-70 of the general 12
49+statutes, (7) aggravated sexual assault of a minor under section 53a-70c 13

44-(2) Notwithstanding any provision of the general statutes, any 16
45-person sentenced to a term of imprisonment for a crime committed on 17
46-or after October 1, 2019, and committed to the custody of the 18
47-Commissioner of Correction on or after said date, except a person who 19
48-is sentenced for a violation of section 53a-54a, 53a-54b, 53a-54c, 53a-20
49-54d, 53a-55, 53a-55a, 53a-59, 53a-59a, 53a-59c, 53a-70, 53a-70a, 53a-70c, 21
50-53a-72b, 53a-92, 53a-92a, 53a-100aa, 53a-101, 53a-111, 53a-134 or 53a-22
51-196a or is a persistent dangerous felony offender or persistent 23
52-dangerous sexual offender pursuant to section 53a-40 or a persistent 24
53-operating while under the influence felony offender pursuant to 25
54-section 53a-40f, may be eligible to earn risk reduction credit toward a 26
55-reduction of such person's sentence, in an amount not to exceed five 27
56-days per month, at the discretion of the Commissioner of Correction 28
57-for conduct as provided in subsection (b) of this section occurring on 29
58-or after April 1, 2006. 30
59-This act shall take effect as follows and shall amend the following
60-sections:

60+53a-111 of the general statutes, (13) robbery in the first degree under 20
61+section 53a-134 of the general statutes, (14) employing a minor in an 21
62+obscene performance under section 53a-196a of the general statutes, 22
63+and (15) being a persistent operating while under the influence felony 23
64+offender under section 53a-40f of the general statutes. 24
6465 Statement of Purpose:
6566 To protect the public by prohibiting persons convicted of serious
6667 felonies from participating in the earned risk reduction credit program.
