AN ACT AUTHORIZING AND REGULATING THE RETAIL SALE OF 
MARIJUANA. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
  Proposed Bill No.   5595

That the general statutes be amended to: (1) Permit the retail sale of 1 
marijuana to adults twenty-one years of age or older; (2) provide that a 2 
certain percentage of revenue generated from taxation on such sale be 3 
allocated toward (A) providing drug awareness education, substance 4 
abuse treatment and efforts to curb abuse of opiates and other harmful 5 
substances, (B) ensuring the marijuana is tested for illicit substances 6 
and potency, (C) studying the impact of marijuana legalization and 7 
consumption, (D) funding the placement of drug-prevention officers in 8 
schools, and (E) creating a public outreach campaign to prevent 9 
distracted driving and driving under the influence of marijuana; (3) 10 
require the Department of Consumer Protection to provide oversight 11 
and regulations of the retail sale and use of marijuana, unless there is a 12 
specific provision for another agency to adopt certain regulations; (4) 13 
require all marijuana of a certain potency be labeled as such and that 14 
such marijuana be packaged in a child-safe manner; (5) provide that 15 
licensed dispensaries, as defined in section 21a-408 of the general 16 
statutes, have initial access to recreational licensing and that the 17 
Department of Consumer Protection shall develop guidelines for 18 
issuing new recreational licenses to unlicensed dispensaries; (6) require 19 
roadside testing of impaired drivers and if a driver is found driving 20 
with at least five nanograms of tetrahydrocannabinol per milliliter in 21 
his or her blood or to have consumed marijuana in the previous two 22 
hours, under the influence laws shall apply; (7) provide for separate 23 
statutory schemes for palliative and recreational use of marijuana; (8) 24 
allow the growth of not more than six marijuana plants for personal 25 
use; (9) ensure that marijuana for palliative use is not subjected to a 26 
retail sales or excise sales tax; (10) require that consumers transport 27 
marijuana in a sealed container; (11) prohibit the public consumption 28 
of recreational marijuana; (12) prohibit any type of marketing and 29 
advertising of the sale of recreational marijuana; (13) require that 30 
twenty-five per cent of licenses issued by the Department of Consumer 31 
Protection for growers, processors, wholesalers and retailers of 32 
recreational marijuana are located in enterprise zones; (14) allow 33 
retailers to deliver directly to the consumer; and (15) expunge 34 
marijuana possession offenses from anyone convicted for marijuana 35  Proposed Bill No.   5595

Statement of Purpose:   
To authorize and regulate the sale and adult use of marijuana in this 
state.
