25 | 25 | beneficiary if (1) the beneficiary sustained a bodily injury in this state, 3 | |
26 | 26 | (2) such beneficiary received health care services resulting from such 4 | |
27 | 27 | injury, (3) Medicare conditionally tendered payment to such 5 | |
28 | 28 | beneficiary for the cost of such services, and (4) such company is 6 | |
29 | 29 | deemed liable for the cost of such services as part of a legal 7 | |
