1818 AN ACT CONCERNING THE VALUATION OF CLASSIC MOTOR
1919 VEHICLES FOLLOWING CONSTRUCTIVE TOTAL LOSSES.
2020 Be it enacted by the Senate and House of Representatives in General

2323 That section 38a-353 of the general statutes be amended to provide 1
2424 that whenever a property and casualty insurer declares a damaged 2
2525 classic motor vehicle that is covered under an automobile insurance 3
2626 policy to be a constructive total loss, the insurer shall, in calculating the 4
2727 value of such vehicle for the purpose of determining the settlement 5
2828 amount to be paid to a claimant, not use any retail value given to such 6
2929 vehicle in an online auction. 7
3030 Statement of Purpose:
3131 To provide that no property and casualty insurer that declares a
3232 damaged classic motor vehicle that is covered under an automobile
3333 insurance policy to be a constructive total loss shall, in calculating the
3434 value of such vehicle for the purpose of determining the settlement
3535 amount to be paid to a claimant, use any retail value given to such
3636 vehicle in an online auction.
