1414 AN ACT CONCERNING TH E USE OF LOCAL CAPITAL
1515 IMPROVEMENT FUND GRA NTS FOR THE REMOVAL OF CERTAIN
1616 TREES.
1717 Be it enacted by the Senate and House of Representatives in General
1818 Assembly convened:

2020 Section 1. Subsection (a) of section 7-536 of the general statutes is 1
2121 repealed and the following is substituted in lieu thereof (Effective July 2
2222 1, 2019): 3
2323 (a) As used in sections 7-535 to 7-538, inclusive: 4
2424 (1) "Adjusted equalized net grand list per capita" means the 5
2525 adjusted equalized net grand list per capita determined for each town 6
2626 pursuant to section 10-261; 7
2727 (2) "Density" means the population of a municipality divided by the 8
2828 number of square miles of the municipality; 9
2929 (3) "Grant anticipation note" means a note issued in anticipation of 10
3030 the receipt of project grants to the municipality from moneys in the 11
3131 Local Capital Improvement Fund; 12
3232 (4) "Local capital improvement project" means a municipal capital 13
3333 expenditure project for any of the following purposes: (A) Road 14
3434 construction, renovation, repair or resurfacing, (B) sidewalk and 15
3535 pavement improvements, (C) construction, renovation, enlargement or 16 Substitute Bill No. 5886

4242 repair of sewage treatment plants and sanitary or storm, water or 17
4343 sewer lines, including separation of lines, (D) public building 18
4444 construction other than schools, including renovation, repair, code 19
4545 compliance, energy conservation and fire safety projects, (E) 20
4646 construction, renovation, enlargement or repair of dams, bridges and 21
4747 flood control projects, (F) construction, renovation, enlargement or 22
4848 repair of water treatment or filtration plants and water mains, (G) 23
4949 construction, renovation or enlargement of solid waste facilities, (H) 24
5050 improvements to public parks, (I) the preparation and revision of local 25
5151 capital improvement plans projected for a period of not less than five 26
5252 years and so prepared as to show the general description, need and 27
5353 estimated cost of each individual capital improvement, (J) 28
5454 improvements to emergency communications systems and building 29
5555 security systems, including for schools, (K) public housing projects, 30
5656 including renovations and improvements and energy conservation and 31
5757 the development of additional housing, (L) renovations to or 32
5858 construction of veterans' memorial monuments, (M) thermal imaging 33
5959 systems, (N) bulky waste and landfill projects, (O) the preparation and 34
6060 revision of municipal plans of conservation and development adopted 35
6161 pursuant to section 8-23, provided such plans are endorsed by the 36
6262 legislative body of the municipality not more than one hundred eighty 37
6363 days after adoption by the commission, (P) acquisition of automatic 38
6464 external defibrillators, (Q) floodplain management and hazard 39
6565 mitigation activities, (R) on-board oil refining systems consisting of a 40
6666 filtration canister and evaporation canister that remove solid and 41
6767 liquid contaminants from lubricating oil, (S) activities related to the 42
6868 planning of a municipal broadband network, provided the speed of 43
6969 the network shall be not less than three hundred eighty-four thousand 44
7070 bits per second, (T) establishment of bikeways and greenways, (U) 45
7171 land acquisition, including for open space, and costs involved in 46
7272 making land available for public uses, (V) acquisition of technology 47
7373 related to implementation of the Department of Education's common 48
7474 core state standards, (W) technology upgrades, including for 49
7575 improvements to expand public access to government information 50

8383 ending June 30, 2013, and June 30, 2014, acquisition of snow removal 52
8484 equipment, capital expenditures made to improve public safety, and 53
8585 capital expenditures made to facilitate regional cooperation, and (Y) 54
8686 for hazardous tree removal or trimming for "nonutility" related 55
8787 hazardous branches, limbs and trees on municipal property or within a 56
8888 municipal right-of-way. "Local capital improvement project" means 57
8989 only capital expenditures and includes repairs incident to 58
9090 reconstruction and renovation but does not include ordinary repairs 59
9191 and maintenance of an ongoing nature. As used in this subdivision, 60
9292 "floodplain management" and "hazard mitigation" have the same 61
9393 meanings as provided in section 25-68j; 62
9494 (5) "Municipality" means any town, city, borough, consolidated 63
9595 town and city or consolidated town and borough; 64
9696 (6) "Population" means the number of persons according to the most 65
9797 recent federal decennial census, except that, in intervening years 66
9898 between such censuses, "population" means the number of persons 67
9999 according to the most recent estimate of the Department of Public 68
100100 Health; and 69
101101 (7) "Secretary" means the Secretary of the Office of Policy and 70
