14	14		AN ACT CONCERNING TH E USE OF LOCAL CAPITAL
15	15		IMPROVEMENT FUND GRA NTS FOR THE REMOVAL OF CERTAIN
16	16		TREES.
17	17		Be it enacted by the Senate and House of Representatives in General
18	18		Assembly convened:

20	20		Section 1. Subsection (a) of section 7-536 of the general statutes is 1
21	21		repealed and the following is substituted in lieu thereof (Effective July 2
22	22		1, 2019): 3
23	23		(a) As used in sections 7-535 to 7-538, inclusive: 4
24	24		(1) "Adjusted equalized net grand list per capita" means the 5
25	25		adjusted equalized net grand list per capita determined for each town 6
26	26		pursuant to section 10-261; 7
27	27		(2) "Density" means the population of a municipality divided by the 8
28	28		number of square miles of the municipality; 9
29	29		(3) "Grant anticipation note" means a note issued in anticipation of 10
30	30		the receipt of project grants to the municipality from moneys in the 11
31	31		Local Capital Improvement Fund; 12
32	32		(4) "Local capital improvement project" means a municipal capital 13
33	33		expenditure project for any of the following purposes: (A) Road 14
34	34		construction, renovation, repair or resurfacing, (B) sidewalk and 15
35	35		pavement improvements, (C) construction, renovation, enlargement or 16 Substitute Bill No. 5886

42	42		repair of sewage treatment plants and sanitary or storm, water or 17
43	43		sewer lines, including separation of lines, (D) public building 18
44	44		construction other than schools, including renovation, repair, code 19
45	45		compliance, energy conservation and fire safety projects, (E) 20
46	46		construction, renovation, enlargement or repair of dams, bridges and 21
47	47		flood control projects, (F) construction, renovation, enlargement or 22
48	48		repair of water treatment or filtration plants and water mains, (G) 23
49	49		construction, renovation or enlargement of solid waste facilities, (H) 24
50	50		improvements to public parks, (I) the preparation and revision of local 25
51	51		capital improvement plans projected for a period of not less than five 26
52	52		years and so prepared as to show the general description, need and 27
53	53		estimated cost of each individual capital improvement, (J) 28
54	54		improvements to emergency communications systems and building 29
55	55		security systems, including for schools, (K) public housing projects, 30
56	56		including renovations and improvements and energy conservation and 31
57	57		the development of additional housing, (L) renovations to or 32
58	58		construction of veterans' memorial monuments, (M) thermal imaging 33
59	59		systems, (N) bulky waste and landfill projects, (O) the preparation and 34
60	60		revision of municipal plans of conservation and development adopted 35
61	61		pursuant to section 8-23, provided such plans are endorsed by the 36
62	62		legislative body of the municipality not more than one hundred eighty 37
63	63		days after adoption by the commission, (P) acquisition of automatic 38
64	64		external defibrillators, (Q) floodplain management and hazard 39
65	65		mitigation activities, (R) on-board oil refining systems consisting of a 40
66	66		filtration canister and evaporation canister that remove solid and 41
67	67		liquid contaminants from lubricating oil, (S) activities related to the 42
68	68		planning of a municipal broadband network, provided the speed of 43
69	69		the network shall be not less than three hundred eighty-four thousand 44
70	70		bits per second, (T) establishment of bikeways and greenways, (U) 45
71	71		land acquisition, including for open space, and costs involved in 46
72	72		making land available for public uses, (V) acquisition of technology 47
73	73		related to implementation of the Department of Education's common 48
74	74		core state standards, (W) technology upgrades, including for 49
75	75		improvements to expand public access to government information 50
76	76		through electronic portals and kiosks, [and] (X) for the fiscal years 51 Substitute Bill No. 5886

83	83		ending June 30, 2013, and June 30, 2014, acquisition of snow removal 52
84	84		equipment, capital expenditures made to improve public safety, and 53
85	85		capital expenditures made to facilitate regional cooperation, and (Y) 54
86	86		for hazardous tree removal or trimming for "nonutility" related 55
87	87		hazardous branches, limbs and trees on municipal property or within a 56
88	88		municipal right-of-way. "Local capital improvement project" means 57
89	89		only capital expenditures and includes repairs incident to 58
90	90		reconstruction and renovation but does not include ordinary repairs 59
91	91		and maintenance of an ongoing nature. As used in this subdivision, 60
92	92		"floodplain management" and "hazard mitigation" have the same 61
93	93		meanings as provided in section 25-68j; 62
94	94		(5) "Municipality" means any town, city, borough, consolidated 63
95	95		town and city or consolidated town and borough; 64
96	96		(6) "Population" means the number of persons according to the most 65
97	97		recent federal decennial census, except that, in intervening years 66
98	98		between such censuses, "population" means the number of persons 67
99	99		according to the most recent estimate of the Department of Public 68
100	100		Health; and 69
101	101		(7) "Secretary" means the Secretary of the Office of Policy and 70
102	102		Management. 71
