AN ACT REQUIRING PLANNING AND ZONING COMMISSION 
APPROVAL OF CERTAIN SOLAR PHOTOVOLTAIC FACILITIES. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
That chapter 277a of the general statutes be amended to require that 1 
each application for a certificate of environmental compatibility and 2 
public need made pursuant to section 16-501 of the general statutes 3 
that concerns the siting of a solar photovoltaic facility with a capacity 4 
of two or more megawatts be approved by the planning and zoning 5 
commission of each municipality in which any portion of the facility is 6 
to be located prior to the granting of a certificate pursuant to section 7 
16-50p of the general statutes, and that section 8-2 of the general 8 
statutes be amended to permit planning and zoning commissions to 9 
establish regulations concerning solar photovoltaic facilities. 10 
Statement of Purpose:   
To require applicants for certificates of environmental compatibility 
and public need to receive application approval from municipal 
planning and zoning commissions if a proposed facility is a solar 
photovoltaic facility with a capacity of two or more megawatts, and to  Proposed Bill No.   5889

permit municipal planning and zoning commissions to establish 
regulations concerning such facilities.
