19-AN ACT REQUIRING ANN UAL REPORTS ON USE OF FO RCE BY
20-STATE AND MUNICIPAL POLICE OFFICERS.

2119 Be it enacted by the Senate and House of Representatives in General

24-Section 1. Section 7-282e of the general statutes is repealed and the 1
25-following is substituted in lieu thereof (Effective from passage): 2
26-(a) Each law enforcement unit, as defined in section 7-294a, shall 3
27-create and maintain a record detailing any incident during which a 4
28-police officer, as defined in section 7-294a, (1) uses physical force that 5
29-is likely to cause serious physical injury, as defined in section 53a-3, to 6
30-another person or the death of another person, including, but not 7
31-limited to, striking another person with an open or closed hand, club 8
32-or baton, kicking another person or using pepper spray or an 9
33-electroshock weapon on another person, or (2) discharges a firearm, 10
34-except during a training exercise or in the course of dispatching an 11
35-animal. Such record shall include, but not be limited to: The name of 12
36-the police officer, the time and place of the incident, a description of 13
37-what occurred during the incident and, to the extent known, the names 14
38-of the victims and witnesses present at such incident. 15

44-(b) Not later than October 1, 2019, the Police Officer Standards and 16
45-Training Council, established pursuant to section 7-294b, shall develop 17
46-and promulgate a standardized form for an annual report that 18
47-compiles the contents of records a law enforcement unit maintains 19
48-pursuant to subsection (a) of this section. The form shall require 20
49-statistics on each incident that is the subject of the record, including, 21
50-but not limited to, (1) the race and gender of each person on whom 22
51-force was used, provided the identification of such characteristics shall 23
52-be based on the observation and perception of the police officer 24
53-involved in the incident, (2) the location of each incident, the type of 25
54-force used and the activities that led to the use of force, and (3) any 26
55-injury suffered by a person against whom force was used. 27
56-(c) Not later than January 15, 2020, and annually thereafter, the 28
57-Division of State Police within the Department of Emergency Services 29
58-and Public Protection and each municipal police department shall 30
59-submit an annual use of force report using the form developed and 31
60-promulgated pursuant to subsection (b) of this section to the Criminal 32
61-Justice Policy and Planning Division within the Office of Policy and 33
62-Management. 34
63-(d) The Office of Policy and Management shall post the annual 35
64-reports submitted pursuant to subsection (c) of this section on its 36
65-Internet web site. 37
66-This act shall take effect as follows and shall amend the following
