2020 AN ACT CONCERNING PE STICIDE REGULATION IN THE STATE.
2121 Be it enacted by the Senate and House of Representatives in General

2424 Section 1. (NEW) (Effective July 1, 2019) There is established an 1
2525 account to be known as the pesticide enforcement account which shall 2
2626 be a separate, nonlapsing account within the General Fund. Moneys in 3
2727 such account shall be used to provide for the costs of regulating 4
2828 pesticides, performing requisite inspections concerning such 5
2929 regulation and any enforcement activities concerning the regulation of 6
3030 pesticides by the Department of Energy and Environmental Protection. 7
3131 All funds collected from the registration of any pesticide pursuant to 8
3232 sections 22a-48 to 22a-50, inclusive, of the general statutes shall be 9
3333 deposited into the pesticide enforcement account. Such account shall 10
3434 contain all moneys required by law to be deposited in such account. 11
3535 Such account may receive funds from private or public sources, 12
3636 including, but not limited to, any municipal government or the federal 13
3737 government. 14
3838 Sec. 2. (NEW) (Effective October 1, 2019) Not later than December 1, 15

4646 implement the use of an electronic reporting and record keeping 17
4747 system for pesticide registrations and private and commercial pesticide 18
4848 applicator permits and certifications. Such system shall include, but 19
4949 not be limited to, components that improve the Department of Energy 20
5050 and Environmental Protection's ability to make available to the public 21
5151 data concerning the use of pesticides in the state. 22
5252 Sec. 3. (NEW) (Effective October 1, 2019) Not later than October 1, 23
5353 2020, the Commissioner of Energy and Environmental Protection shall 24
5454 adopt regulations, in accordance with the provisions of chapter 54 of 25
5555 the general statutes, to: (1) Regulate the on-line purchase of restricted 26
5656 use pesticides in order to assure that such restricted use pesticides are 27
5757 not purchased and applied by persons who are not authorized to 28
5858 possess and apply such pesticides in accordance with the provisions of 29
5959 chapter 441 of the general statutes; and (2) implement and conduct a 30
6060 monitoring program that accurately and effectively determines levels 31
6161 of pesticides in the soil, water and natural resources of the state, 32
6262 including, but not limited to, the state's wildlife. 33
6363 This act shall take effect as follows and shall amend the following
