20 | 20 | | AN ACT CONCERNING PE STICIDE REGULATION IN THE STATE. |

21 | 21 | | Be it enacted by the Senate and House of Representatives in General |

22 | 22 | | Assembly convened: |

24 | 24 | | Section 1. (NEW) (Effective July 1, 2019) There is established an 1 |
---|
25 | 25 | | account to be known as the pesticide enforcement account which shall 2 |
---|
26 | 26 | | be a separate, nonlapsing account within the General Fund. Moneys in 3 |
---|
27 | 27 | | such account shall be used to provide for the costs of regulating 4 |
---|
28 | 28 | | pesticides, performing requisite inspections concerning such 5 |
---|
29 | 29 | | regulation and any enforcement activities concerning the regulation of 6 |
---|
30 | 30 | | pesticides by the Department of Energy and Environmental Protection. 7 |
---|
31 | 31 | | All funds collected from the registration of any pesticide pursuant to 8 |
---|
32 | 32 | | sections 22a-48 to 22a-50, inclusive, of the general statutes shall be 9 |
---|
33 | 33 | | deposited into the pesticide enforcement account. Such account shall 10 |
---|
34 | 34 | | contain all moneys required by law to be deposited in such account. 11 |
---|
35 | 35 | | Such account may receive funds from private or public sources, 12 |
---|
36 | 36 | | including, but not limited to, any municipal government or the federal 13 |
---|
37 | 37 | | government. 14 |

38 | 38 | | Sec. 2. (NEW) (Effective October 1, 2019) Not later than December 1, 15 |

47 | 47 | | system for pesticide registrations and private and commercial pesticide 18 |
---|
48 | 48 | | applicator permits and certifications. Such system shall include, but 19 |
---|
49 | 49 | | not be limited to, components that improve the Department of Energy 20 |
---|
50 | 50 | | and Environmental Protection's ability to make available to the public 21 |
---|
51 | 51 | | data concerning the use of pesticides in the state. 22 |
---|
52 | 52 | | Sec. 3. (NEW) (Effective October 1, 2019) Not later than October 1, 23 |
---|
53 | 53 | | 2020, the Commissioner of Energy and Environmental Protection shall 24 |
---|
54 | 54 | | adopt regulations, in accordance with the provisions of chapter 54 of 25 |
---|
55 | 55 | | the general statutes, to: (1) Regulate the on-line purchase of restricted 26 |
---|
56 | 56 | | use pesticides in order to assure that such restricted use pesticides are 27 |
---|
57 | 57 | | not purchased and applied by persons who are not authorized to 28 |
---|
58 | 58 | | possess and apply such pesticides in accordance with the provisions of 29 |
---|
59 | 59 | | chapter 441 of the general statutes; and (2) implement and conduct a 30 |
---|
60 | 60 | | monitoring program that accurately and effectively determines levels 31 |
---|
61 | 61 | | of pesticides in the soil, water and natural resources of the state, 32 |
---|
62 | 62 | | including, but not limited to, the state's wildlife. 33 |
---|
63 | 63 | | This act shall take effect as follows and shall amend the following |
