2121 AN ACT CONCERNING THE TRANSFER OF JUVENILE FELONY
2222 OFFENDERS TO THE REGULAR CRIMINAL DOCKET.
2323 Be it enacted by the Senate and House of Representatives in General
2424 Assembly convened:

2626 That section 46b-127 of the general statutes be amended to provide 1
2727 that in the case of a discretionary transfer, in order for the court to 2
2828 make a determination concerning any such potential transfer: (1) The 3
2929 juvenile and their parent or legal guardian shall participate in a class 4
3030 or program selected from a list provided by the prosecutorial official, 5
3131 regarding ways to resolve certain behavioral issues, and that the court 6
3232 take into consideration the juvenile's participation in such class or 7
3333 program when making a determination on the transfer, provided such 8
3434 juvenile may only apply for any such class or program once during 9
3535 any three-year period and that this subdivision shall not apply to 10
3636 subsequent arrests during the same three-year period; and (2) the court 11
3737 formulate its determination, with no requirement that required factors 12
3838 for consideration be weighed equally, but that the court shall consider 13
3939 (A) the best interests of the child in maintaining the case with the 14
4040 docket for juvenile matters, and (B) the best interest of the public in 15
4141 maintaining the case with the docket for juvenile matters. 16 Proposed Bill No. 6102
