20	20		AN ACT REQUIRING THE USE OF HELMETS BY MOTORC YCLE
21	21		OPERATORS AND PASSEN GERS UNDER TWENTY -ONE YEARS OF
22	22		AGE.
23	23		Be it enacted by the Senate and House of Representatives in General
24	24		Assembly convened:

26	26		Section 1. Section 14-289g of the general statutes is repealed and the 1
27	27		following is substituted in lieu thereof (Effective October 1, 2019): 2
28	28		(a) No person under [eighteen] twenty-one years of age may (1) 3
29	29		operate a motorcycle or a motor-driven cycle, as defined in section 14-4
30	30		1, or (2) be a passenger on a motorcycle or motor-driven cycle, unless 5
31	31		such operator or passenger is wearing protective headgear of a type 6
32	32		which conforms to the minimum specifications established in 49 CFR 7
33	33		571.218, as amended from time to time. Any person who violates this 8
34	34		section shall have committed an infraction and shall be fined not less 9
35	35		than ninety dollars. 10
36	36		(b) As used in this section, the term "motorcycle" [shall] does not 11
37	37		include "autocycle". 12
38	38		Sec. 2. Subsection (b) of section 14-40a of the general statutes is 13

47	46		(b) A person who is sixteen years of age or older and who has not 16
48	47		had such a license suspended or revoked may apply to the 17
49	48		commissioner for a motorcycle instruction permit. The commissioner 18
50	49		may issue a motorcycle instruction permit, containing [such] any 19
51	50		limitation as [said] the commissioner deems advisable, to an applicant 20
52	51		after the applicant has passed all parts of the examination, other than 21
53	52		the driving skills test, for a motor vehicle operator's license with a 22
54	53		motorcycle endorsement as required by subsection (c) of this section. 23
55	54		The motorcycle instruction permit shall entitle the applicant, while 24
56	55		[said] the applicant is in immediate possession of [said] the permit, to 25
57	56		drive a motorcycle on the public highways, other than multiple lane, 26
58	57		limited access highways, for a period of sixty days. A motorcycle 27
59	58		instruction permit may be renewed, or a new permit issued, for an 28
60	59		additional period of sixty days. Each applicant issued a motorcycle 29
61	60		instruction permit shall, while operating a motorcycle, wear protective 30
62	61		headgear [of a type which conforms to the minimum specifications 31
63	62		established by regulations adopted under subsection (b) of] as required 32
64	63		by section 14-289g, as amended by this act. 33
