AN ACT CONCERNING BIFURCATED TRIALS FOR NEGLIGENCE 
ACTIONS. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
That section 52-205 of the general statutes be amended to provide 1 
that: (1) There shall be a rebuttable presumption that a court may order 2 
that any negligence action that is to be tried to a jury may be 3 
bifurcated; (2) during the first phase of such trial the jury shall make a 4 
determination on the issue of negligence; and (3) the second phase of 5 
such trial shall address the issue of damages. 6 
Statement of Purpose:   
To establish a bifurcated trial system for negligence actions.
