AN ACT CONCERNING MUNICIPAL LIABILITY FOR DAMAGES TO
PERSON OR PROPERTY.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
That subdivision (8) of subsection (b) of section 52-557n of the 1
general statutes be amended to include that, for purposes of said 2
subdivision, a person acts with reckless disregard when he or she is 3
aware of and consciously disregards a substantial and unjustifiable 4
risk that an act or omission will harm an identifiable person. 5
Statement of Purpose:
To correlate the statute to the identifiable person-imminent harm
exception for negligent acts committed by a municipal official.
