Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. Section 8-3f of the general statutes is repealed and the 1 following is substituted in lieu thereof (Effective October 1, 2019): 2 (a) As used in this section, "sidewalk" means any walk laid out as 3 such by any municipality, and any walk which is reserved by custom 4 for the use of pedestrians, or which has been specially prepared for 5 pedestrian use. 6 (b) No community residence or child-care residential facility 7 established pursuant to section 8-3e shall be established within one 8 thousand feet of any other such community residence or child-care 9 residential facility without the approval of the body exercising zoning 10 powers within the municipality in which such residence is proposed to 11 be established. Such distance shall be measured from the point at 12 which the driveway of an existing community residence or child-care 13 residential facility meets a (1) municipal road, as defined in section 14 13a-110a, a state highway, as defined in section 13a-1 or other road or 15 Committee Bill No. 6352 LCO 6417 {\\PRDFS1\HCOUSERS\BARRYJN\WS\2019HB-06352- R02-HB.docx } 2 of 2 highway, to the point at which the driveway of a proposed community 16 residence or child-care residential facility meets or will meet a 17 municipal road, state highway or other road or highway, utilizing the 18 shortest route available to vehicular traffic, or (2) sidewalk, to the point 19 at which the driveway of a proposed community residence or child-20 care residential facility meets or will meet a sidewalk, utilizing the 21 shortest route available to pedestrians, whichever distance is shorter. 22 This act shall take effect as follows and shall amend the following sections: Section 1 October 1, 2019 8-3f PD Joint Favorable
