1818 AN ACT CONCERNING DISCRETIONARY TRANSFERS OF
1919 JUVENILES TO THE REGULAR CRIMINAL DOCKET.
2020 Be it enacted by the Senate and House of Representatives in General
2121 Assembly convened:

2323 That section 46b-127 of the general statutes be amended to provide 1
2424 that in the case of a discretionary transfer, in order for the court to 2
2525 make a determination concerning any such potential transfer: (1) The 3
2626 juvenile and their parent or legal guardian shall participate in a class 4
2727 or program selected from a list provided by the prosecutorial official, 5
2828 regarding ways to resolve certain behavioral issues, and that the court 6
2929 take into consideration the juvenile's participation in such class or 7
3030 program when making a determination on the transfer, provided such 8
3131 juvenile may only apply for any such class or program once during 9
3232 any three-year period and that this subdivision shall not apply to 10
3333 subsequent arrests during the same three-year period; and (2) the court 11
3434 formulate its determination, with no requirement that required factors 12
3535 for consideration be weighed equally, but that the court shall consider 13
3636 (A) the best interests of the child in maintaining the case with the 14
3737 docket for juvenile matters, and (B) the best interest of the public in 15
3838 maintaining the case with the docket for juvenile matters. 16 Proposed Bill No. 6500
