17 | 17 | | Be it enacted by the Senate and House of Representatives in General |

18 | 18 | | Assembly convened: |

20 | 20 | | Section 1. (NEW) (Effective July 1, 2019) (a) For purposes of this 1 |
---|
21 | 21 | | section: (1) "Methadone maintenance" means a chemical maintenance 2 |
---|
22 | 22 | | program under which an addiction to one drug, including, but not 3 |
---|
23 | 23 | | limited to, heroin, is treated with the drug methadone in a weekly 4 |
---|
24 | 24 | | program that includes on and off-site methadone administration, drug 5 |
---|
25 | 25 | | testing and counseling; and (2) "chemical maintenance provider" 6 |
---|
26 | 26 | | means a provider certified and licensed by the federal Substance 7 |
---|
27 | 27 | | Abuse and Mental Health Services Administration and the state 8 |
---|
28 | 28 | | Department of Public Health who meets all federal and state 9 |
---|
29 | 29 | | requirements, including, but not limited to, requirements specific to 10 |
---|
30 | 30 | | the provision of chemical maintenance services. 11 |
---|
31 | 31 | | (b) The Commissioner of Social Services shall amend the Medicaid 12 |
---|
32 | 32 | | state plan to supplement provider-specific weekly methadone 13 |
---|
33 | 33 | | maintenance reimbursement rates with a more equitable minimum 14 |
---|
34 | 34 | | reimbursement rate applied equally to all chemical maintenance 15 |
---|
