1420 AN ACT CONCERNING INTERDIST RICT MAGNET SCHOOL
1521 PROGRAM FUNDING.
1622 Be it enacted by the Senate and House of Representatives in General
1723 Assembly convened:

1925 Section 1. Subsection (c) of section 10-264l of the general statutes is 1
2026 repealed and the following is substituted in lieu thereof (Effective July 2
2127 1, 2019): 3
2228 (c) (1) The maximum amount each interdistrict magnet school 4
2329 program, except those described in subparagraphs (A) to (G), 5
2430 inclusive, of subdivision (3) of this subsection, shall be eligible to 6
2531 receive per enrolled student who is not a resident of the town 7
2632 operating the magnet school shall be (A) six thousand sixteen dollars 8
2733 for the fiscal year ending June 30, 2008, (B) six thousand seven 9
2834 hundred thirty dollars for the fiscal years ending June 30, 2009, to June 10
2935 30, 2012, inclusive, [and] (C) seven thousand eighty-five dollars for the 11
3036 fiscal [year] years ending June 30, 2013, to June 30, 2019, inclusive, and 12
31-(D) seven thousand two hundred twenty-seven dollars for the fiscal 13
32-year ending June 30, 2020, and each fiscal year thereafter. The per 14
33-pupil grant for each enrolled student who is a resident of the town 15
34-operating the magnet school program shall be (i) three thousand 16
35-dollars for the fiscal [year] years ending June 30, 2008, to June 30, 2019, 17
36-inclusive, and (ii) three thousand sixty dollars for the fiscal year ending 18
37-June 30, 2020, and each fiscal year thereafter. 19 Substitute Bill No. 7109
37+(D) seven thousand four hundred thirty-nine dollars for the fiscal year 13
38+ending June 30, 2020, and each fiscal year thereafter. The per pupil 14
39+grant for each enrolled student who is a resident of the town operating 15

47+fiscal [year] years ending June 30, 2008, to June 30, 2019, inclusive, and 17
48+(ii) three thousand one hundred fifty dollars for the fiscal year ending 18
49+June 30, 2020, and each fiscal year thereafter. 19
4450 (2) For the fiscal year ending June 30, 2003, and each fiscal year 20
4551 thereafter, the commissioner may, within available appropriations, 21
4652 provide supplemental grants for the purposes of enhancing 22
4753 educational programs in such interdistrict magnet schools, as the 23
4854 commissioner determines. Such grants shall be made after the 24
4955 commissioner has conducted a comprehensive financial review and 25
5056 approved the total operating budget for such schools, including all 26
5157 revenue and expenditure estimates. 27
5258 (3) (A) Except as otherwise provided in subparagraphs (C) to (G), 28
5359 inclusive, of this subdivision, each interdistrict magnet school operated 29
5460 by a regional educational service center that enrolls less than fifty-five 30
5561 per cent of the school's students from a single town shall receive a per 31
5662 pupil grant in the amount of (i) six thousand two hundred fifty dollars 32
5763 for the fiscal year ending June 30, 2006, (ii) six thousand five hundred 33
5864 dollars for the fiscal year ending June 30, 2007, (iii) seven thousand 34
5965 sixty dollars for the fiscal year ending June 30, 2008, (iv) seven 35
6066 thousand six hundred twenty dollars for the fiscal years ending June 36
6167 30, 2009, to June 30, 2012, inclusive, [and] (v) seven thousand nine 37
6268 hundred dollars for the fiscal [year] years ending June 30, 2013, to June 38
63-30, 2019, inclusive, and (vi) eight thousand fifty-eight dollars for the 39
64-fiscal year ending June 30, 2020, and each fiscal year thereafter. 40
65-(B) Except as otherwise provided in subparagraphs (C) to (G), 41
66-inclusive, of this subdivision, each interdistrict magnet school operated 42
67-by a regional educational service center that enrolls at least fifty-five 43
68-per cent of the school's students from a single town shall receive a per 44
69-pupil grant for each enrolled student who is not a resident of the 45
70-district that enrolls at least fifty-five per cent of the school's students in 46
71-the amount of (i) six thousand sixteen dollars for the fiscal year ending 47
72-June 30, 2008, (ii) six thousand seven hundred thirty dollars for the 48
73-fiscal years ending June 30, 2009, to June 30, 2012, inclusive, [and] (iii) 49
74-seven thousand eighty-five dollars for the fiscal [year] years ending 50
75-June 30, 2013, to June 30, 2019, inclusive, and (iv) seven thousand two 51

72+(B) Except as otherwise provided in subparagraphs (C) to (G), 42

83-and each fiscal year thereafter. The per pupil grant for each enrolled 53
84-student who is a resident of the district that enrolls at least fifty-five 54
85-per cent of the school's students shall be three thousand one hundred 55
86-fifty dollars. 56
87-(C) (i) For the fiscal [year] years ending June 30, 2015, [and each 57
88-fiscal year thereafter] to June 30, 2019, inclusive, each interdistrict 58
89-magnet school operated by a regional educational service center that 59
90-began operations for the school year commencing July 1, 2001, and that 60
91-for the school year commencing July 1, 2008, enrolled at least fifty-five 61
92-per cent, but no more than eighty per cent of the school's students from 62
93-a single town, shall receive a per pupil grant [(i)] (I) for each enrolled 63
94-student who is a resident of the district that enrolls at least fifty-five 64
95-per cent, but no more than eighty per cent of the school's students, up 65
96-to an amount equal to the total number of such enrolled students as of 66
97-October 1, 2013, using the data of record, in the amount of eight 67
98-thousand one hundred eighty dollars, [(ii)] (II) for each enrolled 68
99-student who is a resident of the district that enrolls at least fifty-five 69
100-per cent, but not more than eighty per cent of the school's students, in 70
101-an amount greater than the total number of such enrolled students as 71
102-of October 1, 2013, using the data of record, in the amount of three 72
103-thousand dollars, [(iii)] (III) for each enrolled student who is not a 73
104-resident of the district that enrolls at least fifty-five per cent, but no 74
105-more than eighty per cent of the school's students, up to an amount 75
106-equal to the total number of such enrolled students as of October 1, 76
107-2013, using the data of record, in the amount of eight thousand one 77
108-hundred eighty dollars, and [(iv)] (IV) for each enrolled student who is 78
109-not a resident of the district that enrolls at least fifty-five per cent, but 79
110-not more than eighty per cent of the school's students, in an amount 80
111-greater than the total number of such enrolled students as of October 1, 81
112-2013, using the data of record, in the amount of seven thousand eighty-82
113-five dollars. 83
114-(ii) For the fiscal year ending June 30, 2020, and each fiscal year 84
115-thereafter, each interdistrict magnet school operated by a regional 85 Substitute Bill No. 7109
86+fiscal years ending June 30, 2009, to June 30, 2012, inclusive, [and] (iii) 50
87+seven thousand eighty-five dollars for the fiscal [year] years ending 51
88+June 30, 2013, to June 30, 2019, inclusive, and (iv) seven thousand four 52
89+hundred thirty-nine dollars for the fiscal year ending June 30, 2020, 53
90+and each fiscal year thereafter. The per pupil grant for each enrolled 54
91+student who is a resident of the district that enrolls at least fifty-five 55
92+per cent of the school's students shall be three thousand one hundred 56
93+fifty dollars. 57
94+(C) (i) For the fiscal [year] years ending June 30, 2015, [and each 58
95+fiscal year thereafter,] to June 30, 2019, inclusive, each interdistrict 59
96+magnet school operated by a regional educational service center that 60
97+began operations for the school year commencing July 1, 2001, and that 61
98+for the school year commencing July 1, 2008, enrolled at least fifty-five 62
99+per cent, but no more than eighty per cent of the school's students from 63
100+a single town, shall receive a per pupil grant [(i)] (I) for each enrolled 64
101+student who is a resident of the district that enrolls at least fifty-five 65
102+per cent, but no more than eighty per cent of the school's students, up 66
103+to an amount equal to the total number of such enrolled students as of 67
104+October 1, 2013, using the data of record, in the amount of eight 68
105+thousand one hundred eighty dollars, [(ii)] (II) for each enrolled 69
106+student who is a resident of the district that enrolls at least fifty-five 70
107+per cent, but not more than eighty per cent of the school's students, in 71
108+an amount greater than the total number of such enrolled students as 72
109+of October 1, 2013, using the data of record, in the amount of three 73
110+thousand dollars, [(iii)] (III) for each enrolled student who is not a 74
111+resident of the district that enrolls at least fifty-five per cent, but no 75
112+more than eighty per cent of the school's students, up to an amount 76
113+equal to the total number of such enrolled students as of October 1, 77

123-commencing July 1, 2001, and that for the school year commencing 87
124-July 1, 2008, enrolled at least fifty-five per cent, but no more than 88
125-eighty per cent of the school's students from a single town, shall 89
126-receive a per pupil grant (I) for each enrolled student who is a resident 90
127-of the district that enrolls at least fifty-five per cent, but no more than 91
128-eighty per cent of the school's students, up to an amount equal to the 92
129-total number of such enrolled students as of October 1, 2013, using the 93
130-data of record, in the amount of eight thousand three hundred forty-94
131-four dollars, (II) for each enrolled student who is a resident of the 95
132-district that enrolls at least fifty-five per cent, but not more than eighty 96
133-per cent of the school's students, in an amount greater than the total 97
134-number of such enrolled students as of October 1, 2013, using the data 98
135-of record, in the amount of three thousand sixty dollars, (III) for each 99
136-enrolled student who is not a resident of the district that enrolls at least 100
137-fifty-five per cent, but no more than eighty per cent of the school's 101
138-students, up to an amount equal to the total number of such enrolled 102
139-students as of October 1, 2013, using the data of record, in the amount 103
140-of eight thousand three hundred forty-four dollars, and (IV) for each 104
141-enrolled student who is not a resident of the district that enrolls at least 105
142-fifty-five per cent, but not more than eighty per cent of the school's 106
143-students, in an amount greater than the total number of such enrolled 107
144-students as of October 1, 2013, using the data of record, in the amount 108
145-of seven thousand two hundred twenty-seven dollars. 109
146-(D) (i) Except as otherwise provided in subparagraph (D)(ii) of this 110
147-[subparagraph] subdivision, each interdistrict magnet school operated 111
148-by (I) a regional educational service center, (II) the Board of Trustees of 112
149-the Community-Technical Colleges on behalf of a regional community-113
150-technical college, (III) the Board of Trustees of the Connecticut State 114
151-University System on behalf of a state university, (IV) the Board of 115
152-Trustees for The University of Connecticut on behalf of the university, 116
153-(V) the board of governors for an independent institution of higher 117
154-education, as defined in subsection (a) of section 10a-173, or the 118
155-equivalent of such a board, on behalf of the independent institution of 119 Substitute Bill No. 7109

127+(ii) For the fiscal year ending June 30, 2020, and each fiscal year 85
128+thereafter, each interdistrict magnet school operated by a regional 86
129+educational service center that began operations for the school year 87

132+eighty per cent of the school's students from a single town, shall 90

138+nine dollars, (II) for each enrolled student who is a resident of the 96
139+district that enrolls at least fifty-five per cent, but not more than eighty 97
140+per cent of the school's students, in an amount greater than the total 98
141+number of such enrolled students as of October 1, 2013, using the data 99
142+of record, in the amount of three thousand one hundred fifty dollars, 100
143+(III) for each enrolled student who is not a resident of the district that 101
144+enrolls at least fifty-five per cent, but no more than eighty per cent of 102
145+the school's students, up to an amount equal to the total number of 103
146+such enrolled students as of October 1, 2013, using the data of record, 104
147+in the amount of eight thousand five hundred eighty-nine dollars, and 105
148+(IV) for each enrolled student who is not a resident of the district that 106
149+enrolls at least fifty-five per cent, but not more than eighty per cent of 107
150+the school's students, in an amount greater than the total number of 108
151+such enrolled students as of October 1, 2013, using the data of record, 109
152+in the amount of seven thousand four hundred thirty-nine dollars. 110
153+(D) (i) Except as otherwise provided in subparagraph (D)(ii) of this 111
154+subparagraph, each interdistrict magnet school operated by (I) a 112
155+regional educational service center, (II) the Board of Trustees of the 113
156+Community-Technical Colleges on behalf of a regional community-114
157+technical college, (III) the Board of Trustees of the Connecticut State 115

162-higher education, except as otherwise provided in subparagraph (E) of 120
163-this subdivision, (VI) cooperative arrangements pursuant to section 10-121
164-158a, (VII) any other third-party not-for-profit corporation approved 122
165-by the commissioner, and (VIII) the Hartford school district for the 123
166-operation of Great Path Academy on behalf of Manchester Community 124
167-College, that enrolls less than sixty per cent of its students from 125
168-Hartford shall receive a per pupil grant in the amount of nine 126
169-thousand six hundred ninety-five dollars for the fiscal year ending 127
170-June 30, 2010, [and] ten thousand four hundred forty-three dollars for 128
171-the fiscal years ending June 30, 2011, to June 30, 2019, inclusive, and 129
172-ten thousand six hundred fifty-two dollars for the fiscal year ending 130
173-June 30, 2020, and each fiscal year thereafter. 131
174-(ii) For the fiscal [year] years ending June 30, 2016, [and each fiscal 132
175-year thereafter] to June 30, 2019, inclusive, any interdistrict magnet 133
176-school described in subparagraph (D)(i) of this [subparagraph] 134
177-subdivision that enrolls less than fifty per cent of its incoming students 135
178-from Hartford shall receive a per pupil grant in the amount of seven 136
179-thousand nine hundred dollars for one-half of the total number of non-137
180-Hartford students enrolled in the school over fifty per cent of the total 138
181-school enrollment and shall receive a per pupil grant in the amount of 139
182-ten thousand four hundred forty-three dollars for the remainder of the 140
183-total school enrollment. For the fiscal year ending June 30, 2020, and 141
184-each fiscal year thereafter, any interdistrict magnet school described in 142
185-subparagraph (D)(i) of this subdivision that enrolls less than fifty per 143
186-cent of its incoming students from Hartford shall receive a per pupil 144
187-grant in the amount of eight thousand fifty-eight dollars for one-half of 145
188-the total number of non-Hartford students enrolled in the school over 146
189-fifty per cent of the total school enrollment and shall receive a per 147
190-pupil grant in the amount of ten thousand six hundred fifty-two 148
191-dollars for the remainder of the total school enrollment. 149
192-(E) For the fiscal year ending June 30, 2015, and each fiscal year 150
193-thereafter, each interdistrict magnet school operated by the board of 151
194-governors for an independent institution of higher education, as 152 Substitute Bill No. 7109
165+Trustees for The University of Connecticut on behalf of the university, 117
166+(V) the board of governors for an independent institution of higher 118
167+education, as defined in subsection (a) of section 10a-173, or the 119
168+equivalent of such a board, on behalf of the independent institution of 120
169+higher education, except as otherwise provided in subparagraph (E) of 121
170+this subdivision, (VI) cooperative arrangements pursuant to section 10-122
171+158a, (VII) any other third-party not-for-profit corporation approved 123
172+by the commissioner, and (VIII) the Hartford school district for the 124
173+operation of Great Path Academy on behalf of Manchester Community 125
174+College, that enrolls less than sixty per cent of its students from 126

181+(ii) For the fiscal [year] years ending June 30, 2016, [and each fiscal 133
182+year thereafter,] to June 30, 2019, inclusive, any interdistrict magnet 134
183+school described in subparagraph (D)(i) of this [subparagraph] 135
184+subdivision that enrolls less than fifty per cent of its incoming students 136
185+from Hartford shall receive a per pupil grant in the amount of seven 137
186+thousand nine hundred dollars for one-half of the total number of non-138
187+Hartford students enrolled in the school over fifty per cent of the total 139
188+school enrollment and shall receive a per pupil grant in the amount of 140
189+ten thousand four hundred forty-three dollars for the remainder of the 141
190+total school enrollment. For the fiscal year ending June 30, 2020, and 142
191+each fiscal year thereafter, any interdistrict magnet school described in 143
192+subparagraph (D)(i) of this subdivision that enrolls less than fifty per 144
193+cent of its incoming students from Hartford shall receive a per pupil 145
194+grant in the amount of eight thousand two hundred ninety-five dollars 146
195+for one-half of the total number of non-Hartford students enrolled in 147
196+the school over fifty per cent of the total school enrollment and shall 148
197+receive a per pupil grant in the amount of ten thousand nine hundred 149

201-defined in subsection (a) of section 10a-173, or the equivalent of such a 153
202-board, on behalf of the independent institution of higher education, 154
203-that (i) began operations for the school year commencing July 1, 2014, 155
204-(ii) enrolls less than sixty per cent of its students from Hartford 156
205-pursuant to the 2008 stipulation and order for Milo Sheff, et al. v. 157
206-William A. O'Neill, et al., as extended, or the 2013 stipulation and 158
207-order for Milo Sheff, et al. v. William A. O'Neill, et al., as extended, and 159
208-(iii) enrolls students at least half-time, shall be eligible to receive a per 160
209-pupil grant (I) equal to sixty-five per cent of the grant amount 161
210-determined pursuant to subparagraph (D) of this subdivision for each 162
211-student who is enrolled at such school for at least two semesters in 163
212-each school year, and (II) equal to thirty-two and one-half per cent of 164
213-the grant amount determined pursuant to subparagraph (D) of this 165
214-subdivision for each student who is enrolled at such school for one 166
215-semester in each school year. 167
216-(F) Each interdistrict magnet school operated by a local or regional 168
217-board of education, pursuant to the decision in Sheff v. O'Neill, 238 169
218-Conn. 1 (1996), or any related stipulation or order in effect, shall 170
219-receive a per pupil grant for each enrolled student who is not a 171
220-resident of the district in the amount of (i) twelve thousand dollars for 172
221-the fiscal year ending June 30, 2010, [and] (ii) thirteen thousand fifty-173
222-four dollars for the fiscal years ending June 30, 2011, to June 30, 2019, 174
223-inclusive, and (iii) thirteen thousand three hundred fifteen dollars for 175
224-the fiscal year ending June 30, 2020, and each fiscal year thereafter. 176
225-(G) In addition to the grants described in subparagraph (E) of this 177
226-subdivision, for the fiscal year ending June 30, 2010, the commissioner 178
227-may, subject to the approval of the Secretary of the Office of Policy and 179
228-Management and the Finance Advisory Committee, established 180
229-pursuant to section 4-93, provide supplemental grants to the Hartford 181
230-school district of up to one thousand fifty-four dollars for each student 182
231-enrolled at an interdistrict magnet school operated by the Hartford 183
232-school district who is not a resident of such district. 184
233-(H) For the fiscal year ending June 30, 2016, and each fiscal year 185 Substitute Bill No. 7109
205+(E) For the fiscal year ending June 30, 2015, and each fiscal year 151
206+thereafter, each interdistrict magnet school operated by the board of 152
207+governors for an independent institution of higher education, as 153
208+defined in subsection (a) of section 10a-173, or the equivalent of such a 154
209+board, on behalf of the independent institution of higher education, 155
210+that (i) began operations for the school year commencing July 1, 2014, 156
211+(ii) enrolls less than sixty per cent of its students from Hartford 157
212+pursuant to the 2008 stipulation and order for Milo Sheff, et al. v. 158
213+William A. O'Neill, et al., as extended, or the 2013 stipulation and 159
214+order for Milo Sheff, et al. v. William A. O'Neill, et al., as extended, and 160
215+(iii) enrolls students at least half-time, shall be eligible to receive a per 161
216+pupil grant (I) equal to sixty-five per cent of the grant amount 162
217+determined pursuant to subparagraph (D) of this subdivision for each 163
218+student who is enrolled at such school for at least two semesters in 164
219+each school year, and (II) equal to thirty-two and one-half per cent of 165
220+the grant amount determined pursuant to subparagraph (D) of this 166
221+subdivision for each student who is enrolled at such school for one 167
222+semester in each school year. 168
223+(F) Each interdistrict magnet school operated by a local or regional 169
224+board of education, pursuant to the decision in Sheff v. O'Neill, 238 170
225+Conn. 1 (1996), or any related stipulation or order in effect, shall 171
226+receive a per pupil grant for each enrolled student who is not a 172

264-by the department as follows: (A) Increases in enrollment in an 210
265-interdistrict magnet school program that is adding planned new grade 211
266-levels for the school years commencing July 1, 2015, and July 1, 2016; 212
267-(B) increases in enrollment in an interdistrict magnet school program 213
268-that added planned new grade levels for the school year commencing 214
269-July 1, 2014, and was funded during the fiscal year ending June 30, 215
270-2015; (C) increases in enrollment in an interdistrict magnet school 216
271-program that is moving into a permanent facility for the school years 217

345-stipulation or order in effect, as determined by the commissioner and 279
346-that provide academic support programs and summer school 280
347-educational programs approved by the commissioner to students 281
348-participating in such interdistrict magnet school program: (A) Regional 282
349-educational service centers, (B) local and regional boards of education, 283
350-(C) the Board of Trustees of the Community-Technical Colleges on 284 Substitute Bill No. 7109
