912 AN ACT CONCERNING TH E AWARD OF DOUBLE OR TREBLE
10-DAMAGES TO AN INJURE D PARTY IN A CIVIL A CTION
11-RESULTING FROM CERTA IN TRAFFIC VIOLATIONS.

1215 Be it enacted by the Senate and House of Representatives in General
1316 Assembly convened:

15-Section 1. Section 14-295 of the general statutes is repealed and the
16-following is substituted in lieu thereof (Effective July 1, 2019, and
17-applicable to any civil action pending on or filed on or after said date):
18-In any civil action to recover damages resulting from personal
19-injury, wrongful death or damage to property, the trier of fact may
20-award double or treble damages if the injured party has specifically
21-pleaded that another party has deliberately or with reckless disregard
22-operated a motor vehicle in violation of section 14-218a, 14-219, 14-222,
23-14-227a or 14-227m, subdivision (1) or (2) of subsection (a) of section
24-14-227n or section 14-230, 14-234, 14-237, 14-239, [or] 14-240a or 14-
25-296aa, and that such violation was a substantial factor in causing such
26-injury, death or damage to property. The owner of a rental or leased
27-motor vehicle shall not be responsible for such damages unless the
28-damages arose from such owner's operation of the motor vehicle.

47+Statement of Legislative Commissioners:
48+In Section 1, the effective date was changed from "Effective from
