1431 AN ACT CONCERNING EN ERGY EFFICIENCY STAN DARDS.
1532 Be it enacted by the Senate and House of Representatives in General

1835 Section 1. Section 16a-48 of the general statutes is repealed and the 1
1936 following is substituted in lieu thereof (Effective July 1, 2019): 2
2037 (a) As used in this section: 3
2138 (1) "Department" means the Department of Energy and 4

2340 (2) "Fluorescent lamp ballast" or "ballast" means a device designed 6

5369 (9) "Torchiere lighting fixture" means a portable electric lighting 30
5470 fixture with a reflector bowl giving light directed upward so as to give 31

5672 (10) "Unit heater" means a self-contained, vented fan-type 33
5773 commercial space heater that uses natural gas or propane and that is 34
5874 designed to be installed without ducts within the heated space. "Unit 35
5975 heater" does not include a product regulated by federal standards 36
6076 pursuant to 42 USC 6291, as amended from time to time, a product that 37
6177 is a direct vent, forced flue heater with a sealed combustion burner, or 38
6278 any oil fired heating system; 39
6379 (11) "Transformer" means a device consisting of two or more coils of 40
6480 insulated wire that transfers alternating current by electromagnetic 41

127141 (23) "Electricity ratio" means the ratio of furnace electricity use to 92

129143 (24) "Boiler" means a space heater that is a self-contained appliance 94

341-(54) "Compensation" means money or any other valuable thing, 270

344-(55) "General service lamp" means a lamp that: (A) Has an American 273
345-National Standards Institute base; (B) is able to operate at a voltage of 274
346-twelve volts or twenty-four volts, at or between one hundred to one 275

348-hundred forty volts, or of two hundred seventy-seven volts for 277
349-integrated lamps, or is able to operate at any voltage for nonintegrated 278
350-lamps; (C) has an initial lumen output of greater than or equal to three 279
351-hundred ten lumens, or two hundred thirty-two lumens for modified 280
352-spectrum general service incandescent lamps, and less than or equal to 281
353-three thousand three hundred lumens; (D) is not a light fixture; (E) is 282
354-not an LED downlight retrofit kit; and (F) is used in general lighting 283
355-applications. "General service lamps" include, but are not limited to, 284
356-general service incandescent lamps, compact fluorescent lamps, 285
357-general service light-emitting diode lamps and general service organic 286
358-light-emitting diode lamps. "General service lamps" do not include: (i) 287
359-Appliance lamps; (ii) black light lamps; (iii) bug lamps; (iv) colored 288
360-lamps; (v) G shape lamps with a diameter of five inches or more as 289

523-(d) (1) The Commissioner of Energy and Environmental Protection 422
524-[shall] may adopt regulations, in accordance with the provisions of 423
525-chapter 54, to implement the provisions of subsections (b) to (h), 424
526-inclusive, of this section and to establish minimum energy efficiency 425
527-standards for the types of new products set forth in subsection (b) of 426
528-this section. The regulations shall provide for the following minimum 427
529-energy efficiency standards: 428
530-(A) Commercial clothes washers shall meet the requirements 429
531-[shown in Table P-3 of section 1605.3 of the California Code of 430
532-Regulations, Title 20: Division 2, Chapter 4, Article 4] of federal 431
533-efficiency standards, provided such standards are equivalent to or 432
534-have a higher efficiency than the standards required by the United 433
535-States Department of Energy on January 1, 2018; 434
536-(B) Commercial refrigerators and freezers shall meet the August 1, 435
537-2004, requirements shown in Table A-6 of said California regulation; 436
538-(C) Illuminated exit signs shall meet the version 2.0 product 437
539-specification of the "Energy Star Program Requirements for Exit Signs" 438
540-developed by the United States Environmental Protection Agency; 439
541-(D) Large packaged air-conditioning equipment having not more 440
542-than seven hundred sixty thousand BTUs per hour of capacity shall 441
543-meet a minimum energy efficiency ratio of 10.0 for units using both 442
544-electric heat and air conditioning or units solely using electric air 443
545-conditioning, and 9.8 for units using both natural gas heat and electric 444
546-air conditioning; 445
547-(E) Large packaged air-conditioning equipment having not less than 446 Substitute Bill No. 7151

560-exceed the energy efficiency values shown in Table 4-2 of the National 453
561-Electrical Manufacturers Association Standard TP-1-2002; 454
562-(G) Torchiere lighting fixtures shall not consume more than one 455
563-hundred ninety watts and shall not be capable of operating with lamps 456
564-that total more than one hundred ninety watts; 457
565-(H) Traffic signal modules shall meet the product specification of 458
566-the "Energy Star Program Requirements for Traffic Signals" developed 459
567-by the United States Environmental Protection Agency that took effect 460
568-in February, 2001, except where the department, in consultation with 461
569-the Commissioner of Transportation, determines that such 462
570-specification would compromise safe signal operation; 463
571-(I) Unit heaters shall not have pilot lights and shall have either 464
572-power venting or an automatic flue damper; 465
573-(J) On or after January 1, 2009, residential furnaces and boilers 466
574-purchased by the state shall meet or exceed the following annual fuel 467
575-utilization efficiency: (i) For gas and propane furnaces, ninety per cent 468

571+(H) Traffic signal modules shall meet the product specification of 462
572+the "Energy Star Program Requirements for Traffic Signals" developed 463
573+by the United States Environmental Protection Agency that took effect 464
574+in February, 2001, except where the department, in consultation with 465
575+the Commissioner of Transportation, determines that such 466
576+specification would compromise safe signal operation; 467
577+(I) Unit heaters shall not have pilot lights and shall have either 468

686-Protection [shall] may adopt regulations, in accordance with the 561
687-provisions of chapter 54, to designate additional products to be subject 562
688-to the provisions of subsections (b) to (h), inclusive, of this section and 563
689-to establish efficiency standards for such products upon a 564
690-determination that such efficiency standards (i) would serve to 565
691-promote energy conservation in the state, (ii) would be cost-effective 566
692-for consumers who purchase and use such new products, and (iii) 567
693-would not impose an unreasonable burden on Connecticut businesses. 568
694-[(B) The Commissioner of Energy and Environmental Protection, in 569
695-consultation with the Multi-State Appliance Standards Collaborative, 570
696-shall identify additional appliance and equipment efficiency standards. 571
697-The commissioner shall review all California standards and may 572

722-efficiency standards set forth in such regulations adopted pursuant to 591
723-subsection (d) of this section. 592
724-(f) The Commissioner of Energy and Environmental Protection shall 593
725-adopt procedures for testing the energy efficiency of the new products 594
726-set forth in subsection (b) of this section or designated by the 595
727-commissioner if such procedures are not provided for in the State 596
728-Building Code. The commissioner shall use United States Department 597
729-of Energy approved test methods, or in the absence of such test 598
730-methods, other appropriate nationally recognized test methods. The 599
731-manufacturers of such products shall cause samples of such products 600
732-to be tested in accordance with the test procedures adopted pursuant 601
733-to this subsection or those specified in the State Building Code. 602

749-AC to DC power supplies shall be labeled as described in the January 612
750-2006 California Code of Regulations, Title 20, Section 1607(9). The 613
751-commissioner [shall promulgate] may adopt regulations governing the 614
752-certification of such products. The commissioner shall publish an 615
753-annual list of any products set forth in [subsection (b)] subsections (b) 616
754-and (i) of this section on the department's Internet web site that 617
755-designates which such products are certified in California and which 618
756-such products not certified in California have demonstrated 619
757-compliance with efficiency standards adopted [by the commissioner 620
758-pursuant to subparagraph (B) of subdivision (3) of subsection (d) of 621
759-this section] in the state of Connecticut. 622
760-(h) The Attorney General may institute proceedings to enforce the 623
761-provisions of subsections (b) to (n), inclusive, of this section. Any 624
762-person who violates any provision of subsections (b) to (n), inclusive, 625
763-of this section shall be subject to a civil penalty of not more than two 626
764-hundred fifty dollars. Each violation of subsections (b) to (n), inclusive, 627
765-of this section shall constitute a separate offense, and each day that 628
766-such violation continues shall constitute a separate offense. 629
767-(i) Notwithstanding subsection (d) of this section, the provisions of 630
768-this subsection and subsections (j) to (n), inclusive, of this section apply 631
769-to the testing, certification and enforcement of efficiency standards for 632
770-the following types of new products sold, offered for sale, lease or rent 633

994-(6) On and after January 1, 2023, no new high color rendering index 813
995-fluorescent lamp may be sold or offered for sale, lease or rent in the 814
996-state unless the efficiency of the new product meets or exceeds the 815
997-efficiency standards set forth in subsection (k) of this section, provided, 816
998-if, on or after January 1, 2022, the state of California adopts a standard 817
999-for such new product, the commissioner may adopt regulations, in 818
1000-accordance with the provisions of chapter 54, to implement the 819
1001-efficiency standards set forth in subsection (k) of this section for such 820
1002-new product before January 1, 2023. 821
1003-(7) On and after January 1, 2021, no general service lamp that is not 822
1004-subject to federal preemption, as determined by the commissioner 823
1005-pursuant to subdivision (1) of this subsection, may be installed for 824
1006-compensation in the state unless the efficiency of the new product 825
1007-meets or exceeds the efficiency standards set forth in subsection (k) of 826 Substitute Bill No. 7151

1057-(2) The commissioner may, after giving prior notice and at 864
1058-reasonable and convenient hours, as determined by the commissioner, 865
1059-periodically inspect or cause inspections to be made of distributors and 866
1060-retailers of new products set forth in subsection (i) of this section to 867
1061-determine compliance with the provisions of this subsection and 868
1062-subsections (i) to (m), inclusive, of this section. The commissioner shall 869
1063-coordinate with the State Building Inspector to conduct or cause to be 870
1064-conducted inspections of newly constructed buildings containing new 871
1065-products that are also subject to the State Building Code before such 872
1066-buildings are occupied. 873
