19	19	AN ACT ENHANCING THE SAFETY OF NURSING HOME RESIDEN TS
20	20	WITH VIDEO CAMERAS.
21	21	Be it enacted by the Senate and House of Representatives in General
22	22	Assembly convened:

24	24	Section 1. (NEW) (Effective July 1, 2019) Each nursing home, as 1
25	25	defined in section 19a-490 of the general statutes, shall, at the request 2
26	26	of a resident or the authorized representative of a resident, install a 3
27	27	video camera in such resident's room, provided: (1) The camera is 4
28	28	installed in a location so that it only records the resident's living 5
29	29	quarters, (2) the resident or such resident's authorized representative 6
30	30	signs any required permissions to ensure the video camera recording 7
31	31	complies with the provisions of the Health Insurance Portability and 8
32	32	Accountability Act of 1996, as amended from time to time, (3) the 9
33	33	resident signs a waiver of liability holding the nursing home harmless 10
34	34	for any unlawful intrusion by a person not employed by the nursing 11
35	35	home on the nursing home's Internet server that may compromise the 12
36	36	privacy of any such video camera recording, and (4) the resident or 13
37	37	such resident's authorized representative (A) monitors the video 14
38	38	camera recordings, either in person or remotely, (B) reports to nursing 15
39	39	home staff any recording that raises concerns about the resident's 16 Raised Bill No. 7232

45	45	safety, and (C) maintains for at least one year an unedited copy of the 17
46	46	video camera recording for use by nursing home staff or law 18
47	47	enforcement to investigate any safety concerns that arise as a result of 19
48	48	the recording. 20
49	49	This act shall take effect as follows and shall amend the following
