1919 AN ACT ENHANCING THE SAFETY OF NURSING HOME RESIDEN TS
2020 WITH VIDEO CAMERAS.
2121 Be it enacted by the Senate and House of Representatives in General
2222 Assembly convened:

2424 Section 1. (NEW) (Effective July 1, 2019) Each nursing home, as 1
2525 defined in section 19a-490 of the general statutes, shall, at the request 2
2626 of a resident or the authorized representative of a resident, install a 3
2727 video camera in such resident's room, provided: (1) The camera is 4
2828 installed in a location so that it only records the resident's living 5
2929 quarters, (2) the resident or such resident's authorized representative 6
3030 signs any required permissions to ensure the video camera recording 7
3131 complies with the provisions of the Health Insurance Portability and 8
3232 Accountability Act of 1996, as amended from time to time, (3) the 9
3333 resident signs a waiver of liability holding the nursing home harmless 10
3434 for any unlawful intrusion by a person not employed by the nursing 11
3535 home on the nursing home's Internet server that may compromise the 12
3636 privacy of any such video camera recording, and (4) the resident or 13
3737 such resident's authorized representative (A) monitors the video 14
3838 camera recordings, either in person or remotely, (B) reports to nursing 15

4545 safety, and (C) maintains for at least one year an unedited copy of the 17
4646 video camera recording for use by nursing home staff or law 18
4747 enforcement to investigate any safety concerns that arise as a result of 19
4848 the recording. 20
4949 This act shall take effect as follows and shall amend the following
