1216 Be it enacted by the Senate and House of Representatives in General

15-Section 1. Section 10-221o of the general statutes is repealed and the
16-following is substituted in lieu thereof (Effective July 1, 2019):
17-(a) Each local and regional board of education shall require each
18-school under its jurisdiction to (1) offer all full day students a daily
19-lunch period of not less than twenty minutes, and (2) include in the
20-regular school day for each student enrolled in elementary school time
21-devoted to physical exercise of not less than twenty minutes in total,
22-except that a planning and placement team may develop a different
23-schedule for a child requiring special education and related services in
24-accordance with chapter 164 and the Individuals With Disabilities
25-Education Act, 20 USC 1400 et seq., as amended from time to time. In
26-the event of a conflict with this section and any provision of chapter
27-164, such other provision of chapter 164 shall be deemed controlling.
28-Nothing in this subsection shall prevent a local or regional board of
29-education from including an additional amount of time, beyond the
30-twenty minutes required for physical exercise, devoted to undirected
31-play during the regular school day for each student enrolled in Substitute House Bill No. 7250

26+minutes in total, except that a planning and placement team may 8
27+develop a different schedule for a child requiring special education 9
28+and related services in accordance with chapter 164 and the 10
29+Individuals With Disabilities Education Act, 20 USC 1400 et seq., as 11
30+amended from time to time. In the event of a conflict with this section 12
31+and any provision of chapter 164, such other provision of chapter 164 13
32+shall be deemed controlling. Nothing in this subsection shall prohibit a 14
33+local or regional board of education from including more than twenty 15
34+minutes of time devoted to physical exercise or undirected play in the 16
35+regular school day for each student enrolled in elementary school. 17

36-(b) Not later than October 1, [2013] 2019, each local and regional
37-board of education shall adopt a policy, as the board deems
38-appropriate, concerning the issue regarding any school employee
39-being involved in preventing a student from participating in the entire
40-time devoted to physical exercise or undirected play in the regular
41-school day, pursuant to subsection (a) of this section, as a form of
42-discipline. For purposes of this section, "school employee" means (1) a
43-teacher, substitute teacher, school administrator, school
44-superintendent, guidance counselor, school counselor, psychologist,
45-social worker, nurse, physician, school paraprofessional or coach
46-employed by a local or regional board of education or working in a
47-public elementary, middle or high school; or (2) any other individual
48-who, in the performance of his or her duties, has regular contact with
49-students and who provides services to or on behalf of students
50-enrolled in a public elementary, middle or high school, pursuant to a
51-contract with the local or regional board of education.
52-Sec. 2. (Effective from passage) (a) There is established a task force to
53-study the issues relating to and the feasibility of including time
54-devoted to undirected play during the regular school day in public
55-elementary schools.
56-(b) The task force shall consist of the following members:
57-(1) Two appointed by the speaker of the House of Representatives,
58-one of whom is a representative of the Connecticut Association of
59-Boards of Education and one of whom is the parent or guardian of a
60-student enrolled in a public school;
61-(2) Two appointed by the president pro tempore of the Senate, one
62-of whom is a representative of the Connecticut Education Association
63-and one of whom is the parent or guardian of a student enrolled in a Substitute House Bill No. 7250

43+board of education shall adopt a policy, as the board deems 19

58+This act shall take effect as follows and shall amend the following
59+sections:

68-(3) One appointed by the majority leader of the House of
69-Representatives, who is a representative of the American Federation of
70-Teachers-Connecticut;
71-(4) One appointed by the majority leader of the Senate, who is a
72-representative of the Connecticut Association of Public School
73-Superintendents;
74-(5) One appointed by the minority leader of the House of
75-Representatives, who is a representative of the Connecticut
76-Association of School Administrators;
77-(6) One appointed by the minority leader of the Senate, who is a
78-representative of the Connecticut Association of Schools; and
79-(7) The Commissioner of Education, or the commissioner's designee.
80-(c) Any member of the task force appointed under subdivision (1),
81-(2), (3), (4), (5) or (6) of subsection (b) of this section may be a member
82-of the General Assembly.
83-(d) All appointments to the task force shall be made not later than
84-thirty days after the effective date of this section. Any vacancy shall be
85-filled by the appointing authority.
86-(e) The speaker of the House of Representatives and the president
87-pro tempore of the Senate shall select the chairpersons of the task force
88-from among the members of the task force. Such chairpersons shall
89-schedule the first meeting of the task force, which shall be held not
90-later than sixty days after the effective date of this section.
91-(f) The administrative staff of the joint standing committee of the
92-General Assembly having cognizance of matters relating to education
93-shall serve as administrative staff of the task force. Substitute House Bill No. 7250

97-(g) Not later than January 1, 2020, the task force shall submit a
98-report on its findings and recommendations to the joint standing
99-committee of the General Assembly having cognizance of matters
100-relating to education, in accordance with the provisions of section 11-
101-4a of the general statutes. The task force shall terminate on the date
102-that it submits such report or January 1, 2020, whichever is later.
