1919 AN ACT CONCERNING TH E RECYCLING OF GLASS.
2020 Be it enacted by the Senate and House of Representatives in General

2323 Section 1. (NEW) (Effective from passage) The Department of Energy 1
2424 and Environmental Protection shall develop a plan for the 2
2525 implementation of best practices for the recycling of glass in the state 3
2626 in order to achieve a best-in-the-nation rate of recycling for such glass 4
2727 and the production of a recycled glass waste stream with the highest 5
2828 level of commercial value. Such plan shall be developed not later than 6
2929 October 1, 2020, and provide for implementation of such plan not later 7
3030 than July 1, 2022. Not later than December 1, 2020, the Commissioner 8
3131 of Energy and Environmental Protection shall submit 9
3232 recommendations for any requisite legislative proposals for the 10
3333 implementation of such plan to the joint standing committee of the 11
3434 General Assembly having cognizance of matters relating to the 12
3535 environment. In developing such plan, the department shall review, 13
3636 but not be limited to, the glass collection and recycling systems 14
3737 implemented in the countries of Belgium, Finland, Sweden, Austria 15

4444 Sec. 2. (NEW) (Effective from passage) (a) On and after July 1, 2022, 17
4545 any beverage container, as defined in section 22a-243 of the general 18
4646 statutes, that is manufactured from glass and sold, offered for sale or 19
4747 distributed in this state shall contain not less than twenty per cent 20
4848 post-consumer glass content. 21
4949 (b) The Commissioner of Energy and Environmental Protection, in 22
5050 consultation with the Commissioner of Consumer Protection, may 23
5151 adopt regulations, in accordance with the provisions of chapter 54 of 24
5252 the general statutes, to implement the provisions of subsection (a) of 25
5353 this section. Such regulations shall include, but not be limited to, (1) 26
5454 requirements for certifications from any manufacturer of such glass 27
5555 beverage containers concerning compliance with such requirement, (2) 28
5656 schedules for periodic manufacturer-funded inspections and tests of 29
5757 such beverage containers sold in the state for purposes of compliance 30
5858 with such requirement, (3) penalties for failure to comply with the 31
5959 provisions of this section and the provisions of such regulations, and 32
6060 (4) incentives and recognition programs, including, but not limited to, 33
6161 department coordinated Internet and social media-based consumer 34
6262 awareness campaigns for manufacturers who exceed the post-35
6363 consumer glass content requirements of subsection (a) of this section. 36
6464 (c) Nothing in this section shall be construed to prohibit any 37
6565 municipality from enacting an ordinance requiring a post-consumer 38
6666 glass content for such glass beverage containers that is greater than the 39
6767 requirement established in subsection (a) of this section. 40
