25 | 25 | | Section 1. Section 7-294ee of the general statutes is repealed and the 1 |
---|
26 | 26 | | following is substituted in lieu thereof (Effective October 1, 2019): 2 |

27 | 27 | | (a) The Police Officer Standards and Training Council, established 3 |
---|
28 | 28 | | under section 7-294b, and the Commissioner of Emergency Services 4 |
---|
29 | 29 | | and Public Protection or the commissioner's designee, shall, within 5 |
---|
30 | 30 | | available appropriations, jointly develop, adopt and revise, as 6 |
---|
31 | 31 | | necessary, minimum standards and practices for the administration 7 |
---|
32 | 32 | | and management of law enforcement units, as defined in section 7-8 |
---|
33 | 33 | | 294a. Such minimum standards and practices shall be based upon 9 |
---|
34 | 34 | | standards established by the International Association of Chiefs of 10 |
---|
35 | 35 | | Police and the Commission on Accreditation for Law Enforcement 11 |
---|
36 | 36 | | Agencies, Inc., and shall include, but need not be limited to, standards 12 |
---|
37 | 37 | | and practices regarding bias-based policing, use of force, response to 13 |
---|
38 | 38 | | crimes of family violence, use of body-worn recording equipment, 14 Raised Bill No. 7381 |
---|

44 | 44 | | complaints that allege misconduct by police officers, use of electronic 15 |
---|
45 | 45 | | defense weapons, eyewitness identification procedures, notifications in 16 |
---|
46 | 46 | | death and related events and pursuits by police officers. Not later than 17 |
---|
47 | 47 | | January 1, 2020, the minimum standards and practices for pursuits by 18 |
---|
48 | 48 | | police officers shall be updated to include standards and practices that 19 |
---|
49 | 49 | | govern the pursuit of a motor vehicle reported as stolen when it is 20 |
---|
50 | 50 | | known to the officer or officers engaged in the pursuit that the 21 |
---|
51 | 51 | | operator of or a passenger in the motor vehicle is a juvenile. The 22 |
---|
52 | 52 | | council shall post such minimum standards and practices on the 23 |
---|
53 | 53 | | council's Internet web site and disseminate such standards and 24 |
---|
54 | 54 | | practices to law enforcement units. The council and commissioner or 25 |
---|
55 | 55 | | the commissioner's designee shall jointly develop a process to review a 26 |
---|
56 | 56 | | law enforcement unit's compliance with such minimum standards and 27 |
---|
57 | 57 | | practices and issue a certificate of compliance with law enforcement 28 |
---|
58 | 58 | | standards and practices to a law enforcement unit that meets or 29 |
---|
59 | 59 | | exceeds such standards and practices. 30 |
---|
60 | 60 | | (b) [On and after January 1, 2019, each] Each law enforcement unit 31 |
---|
61 | 61 | | shall adopt, update and maintain (1) the minimum standards and 32 |
---|
62 | 62 | | practices developed by the council pursuant to subsection (a) of this 33 |
---|
63 | 63 | | section, or (2) a higher level of accreditation standards developed by 34 |
---|
64 | 64 | | the council or the Commission on Accreditation for Law Enforcement 35 |
---|
65 | 65 | | Agencies, Inc. 36 |
---|
66 | 66 | | (c) No civil action may be brought against a law enforcement unit 37 |
---|
67 | 67 | | for damages arising from the failure of the law enforcement unit to 38 |
---|
68 | 68 | | adopt and maintain such minimum standards and practices or a higher 39 |
---|
69 | 69 | | level of accreditation standards. 40 |
