1219 AN ACT ESTABLISHING THE STATE CAPITOL COMPLEX FUND FOR
1320 CAPITAL EXPENDITURE PROGRAMS AT THE STAT E CAPITOL AND
1421 THE OLD STATE HOUSE AND A TAX CREDIT FOR DONATIONS TO
1522 SAID FUND.
1623 Be it enacted by the Senate and House of Representatives in General
1724 Assembly convened:

1926 Section 1. Section 2-71h of the general statutes is repealed and the 1
2027 following is substituted in lieu thereof (Effective July 1, 2019): 2
2128 (a) The supervision, security, utilization and control of the State 3
2229 Capitol building, the State Capitol grounds and parking facilities, 4
2330 exclusive of the present offices and parking facilities of the Governor, 5
2431 Lieutenant Governor, Secretary of the State and Secretary of the Office 6
2532 of Policy and Management and their respective staffs, the Legislative 7
2633 Office Building and parking garage and related structures and the 8
2734 grounds and parking facilities thereon, and other facilities and areas 9
2835 made available to or used by the committee shall be as determined by 10
2936 the Joint Committee on Legislative Management. The Joint Committee 11
3037 on Legislative Management shall maintain such buildings, related 12
3138 structures, grounds and parking facilities. The Joint Committee on 13

3245 Legislative Management shall adopt regulations (1) for the 14
3346 maintenance of order within such buildings and related structures and 15
3447 on such grounds and on those grounds, buildings and facilities made 16
3548 available for the use of said committee, and (2) establishing the regular 17
3649 business hours for such buildings and all offices housed within such 18

50+buildings. Any person violating any such regulations shall be fined not 19
4451 more than one hundred dollars, except that any person who parks a 20
4552 motor vehicle in violation of such regulations shall have committed an 21
4653 infraction and shall be fined not more than ninety dollars. The 22
4754 enforcement of such regulations shall be by the Office of State Capitol 23
4855 Police. Notwithstanding the provisions of this subsection, the 24
4956 Commissioner of Administrative Services may provide for additional 25
5057 parking on land under the control of the Joint Committee on 26
5158 Legislative Management with the approval of said committee. 27
5259 (b) The Joint Committee on Legislative Management shall assign 28
5360 permanent office space in a room in a building under its control for the 29
5461 use of authorized representatives of newspapers and press 30
5562 associations. 31
5663 (c) The Joint Committee on Legislative Management shall cause the 32
5764 national and state flags to be displayed on the State Capitol and at the 33
5865 Legislative Office Building from sunrise to sunset of each day. 34
5966 (d) (1) There is established a fund to be known as the "State Capitol 35
6067 Complex Fund". The fund may contain any moneys required or 36
6168 permitted to be deposited in the fund and shall be held by the 37
6269 Comptroller separate and apart from all other moneys, funds and 38
6370 accounts. Investment earnings credited to the assets of the fund shall 39
6471 become part of the assets of said fund. Any balance remaining in the 40
6572 fund at the end of any fiscal year shall be carried forward in the fund 41
6673 for the fiscal year next succeeding. 42
6774 (2) Moneys in the fund shall be used by the executive director of the 43
6875 Joint Committee on Legislative Management, with the approval of the 44

6982 committee, for capital expenditure programs and historic preservation 45
7083 and restoration projects at the State Capitol and the Old State House. 46
7184 Sec. 2. (NEW) (Effective July 1, 2019) (a) Any company, as defined in 47
7285 section 12-1 of the general statutes, may make a voluntary, unrestricted 48
7386 and irrevocable cash donation or donations to the State Capitol 49

8188 general statutes, as amended by this act. The Comptroller shall issue a 51
8289 receipt or voucher, in a form and manner as prescribed by the 52
8390 Commissioner of Revenue Services, to the donor company that entitles 53
8491 such company to a credit, provided the aggregate amount of all credits 54
8592 issued under this section in any fiscal year shall not exceed five million 55
8693 dollars. Such receipt or voucher shall include the name and address of 56
8794 the company, the tax identification number of the company, the 57
8895 amount of the cash donation received, the date of such receipt and any 58
8996 additional information the commissioner may require. 59
9097 (b) (1) The credit authorized under this section may be claimed 60
9198 against the tax imposed under chapter 207, 208, 209, 210, 211 or 212 of 61
9299 the general statutes, commencing with the income year in which the 62
93100 cash donation was made. Any credit not used for such income year 63
94101 may be carried forward and credited against the tax imposed for the 64
95102 succeeding five income years or until the full credit is used, whichever 65
96103 occurs first. 66
97104 (2) Any company entitled to a credit under this section may sell, 67
98105 assign or otherwise transfer such credit, in whole or in part, to one or 68
99106 more taxpayers to offset any tax due or otherwise payable by such 69
100107 taxpayers under chapter 207, 208, 209, 210, 211 or 212 of the general 70
101108 statutes, provided such credit may not be sold, assigned or otherwise 71
102109 transferred, in whole or in part, more than three times. 72
103110 (3) Any company claiming a credit under this section, in whole or in 73
104111 part, shall provide any documentation or informatio n the 74
105112 Commissioner of Revenue Services requires to verify the claim. 75

106119 (c) (1) The Comptroller shall provide to the Commissioner of 76
107120 Revenue Services any documentation or information the commissioner 77
108121 requests or requires to administer the credits authorized under this 78

121128 Sec. 3. Section 4b-60 of the general statutes is repealed and the 85
122129 following is substituted in lieu thereof (Effective July 1, 2019): 86
123130 (a) There shall be a State Commission on Capitol Preservation and 87
124131 Restoration to consist of twelve members to be appointed as follows: 88
125132 Two members shall be appointed by the Governor, two by the speaker 89
126133 of the House of Representatives, two by the president pro tempore of 90
127134 the Senate, one by the House minority leader, one by the Senate 91
128135 minority leader, two members of the Joint Committee on Legislative 92
129136 Management, one appointed by each of the chairmen of said 93
130137 committee, and one member of the Culture and Tourism Advisory 94
131138 Committee appointed by its chairperson. The Commissioner of 95
132139 Administrative Services, or the commissioner's designee, shall be an 96
133140 ex-officio member of the commission and shall attend its meetings. 97
134141 Vacancies on the commission shall be filled by the original appointing 98
135142 authority for the unexpired portion of the term. The members shall 99
136143 serve without compensation for their services but shall be reimbursed 100
137144 for their actual and necessary expenses incurred in the performance of 101
138145 their duties. The commission shall meet at least quarterly, and more 102
139146 often on the call of the chairman or on the written request of a majority 103
140147 of the members. The commission may designate subcommittees to 104
141148 carry out its functions. Any member who fails to attend three 105
142149 consecutive meetings or fails to attend fifty per cent of all meetings 106
143150 held during any calendar year shall be deemed to have resigned. 107

144157 (b) The commission: (1) Shall undertake a continuing review and 108
145158 study of the State Capitol building and grounds, with a view to 109
146159 developing a master plan for the preservation and restoration of the 110
147160 Capitol, including necessary structural changes, consistent with the 111
148161 original historical character of the building, with due regard being 112
149162 given to enhancing the interior and exterior beauty of the building, 113

157164 hazards; (2) may consult with state, federal or private agencies with 115
158165 respect thereto, and disseminate information on its activities; and (3) 116
159166 shall report on its activities to the Joint Committee on Legislative 117
160167 Management annually or as often as the committee shall direct. The 118
161168 Department of Administrative Services shall provide professional staff 119
162169 assistance to the commission when available. If such assistance cannot 120
163170 be provided within a reasonable time, the commission may, with the 121
164171 approval of the Joint Committee on Legislative Management, retain 122
165172 technical advisors to assist in reviewing project plans and work. 123
166173 (c) The commission is authorized to accept gifts, donations and 124
167174 grants from the federal government or other public or private sources 125
168175 for the purpose of such preservation and restoration. 126
169176 (d) The Joint Committee on Legislative Management may undertake 127
170177 capital expenditure programs (1) for which capital funds are 128
171178 authorized [,] in connection with such preservation and restoration, 129
172179 and (2) at the State Capitol and the Old State House, as set forth in 130
173180 subsection (d) of section 2-71h, as amended by this act, for which 131
174181 donations have been made in accordance with section 2 of this act. 132
175182 Such programs shall be carried out by the committee, pursuant to 133
176183 plans and specifications approved by the commission and in 134
177184 accordance with the bidding procedures in part II of chapter 60. The 135
178185 commission shall adopt regulations establishing basic artistic 136
179186 standards in keeping with the original historical character of the 137
180187 Capitol to assist the committee in the preparation of plans and 138
181188 specifications. 139

182195 (e) The commission shall be an independent body within the 140
183196 Legislative Department for administrative purposes only. 141
