1420 AN ACT AMENDING THE CONVEYANCE OF CERTAIN PARCELS OF
1521 STATE LAND IN THE TOWN OF MANSFIELD.
1622 Be it enacted by the Senate and House of Representatives in General
1723 Assembly convened:

1925 Section 1. Section 3 of special act 89-54 is amended to read as 1
2026 follows (Effective from passage): 2
2127 (a) Notwithstanding any provision of the general statutes to the 3
2228 contrary, the [commissioner of mental retardation] Commissioner of 4
2329 Developmental Services shall convey to the town of Mansfield, subject 5
2430 to the approval of the [state properties review board] State Properties 6
2531 Review Board and at a cost equal to the administrative costs of making 7
2632 such conveyance, two parcels of land located in the town of Mansfield, 8
2733 having a total area of approximately 16 acres. The first parcel of land 9
2834 contains approximately 15.6 acres, is a portion of a larger parcel 10
2935 conveyed to the state of Connecticut by William P. Kelley and 11
3036 recorded in the Mansfield Land Records at Volume 47, Page 227 and is 12
3137 the same property shown on a map entitled "Map Showing Land of the 13
32-State of Connecticut to be Acquired by the Town of Mansfield" dated 14
33-December 1988, scale 1" = 40 feet, 2 sheets certified A-2 by Grant 15
34-Meitzler, RLS #10,005, which map is filed in the Mansfield Land 16
35-Records. Said parcel of land shall be conveyed subject to an access 17
36-easement of record in favor of Raymond E. and Marianne Gergler, 18
37-which is of unspecified width giving a right to pass over said parcel 19 Substitute Bill No. 7418

45-The second parcel of land is a triangular parcel of land located 21
46-westerly of the southwesterly corner of land of Gergler, easterly of the 22
47-Central Vermont Railroad Company land, and northerly of the 23
48-northwesterly corner of the first parcel herein described and is the 24
49-same property shown on a map entitled "Map Showing Land of State 25
50-of Connecticut to be acquired by the Town of Mansfield", dated 26
51-January 1989, scale 1" = 20 feet, sheet 2-A of 2, certified Class D by 27
52-Grant Meitzler, RLS #10,005, which map is to be filed in the Mansfield 28
53-[land records] Land Records. The conveyance of said parcels of land 29
54-shall include transfer of rights to the abandoned railroad siding on said 30
55-parcels to the town of Mansfield, and the right to the use of the existing 31
56-sewer line, water line, and utility lines located on Connecticut Light 32
57-and Power Company poles 21, 22, 23 and 24, on terms negotiated by 33
58-the [commissioner of mental retardation] Commissioner of 34
59-Developmental Services and the town of Mansfield. The locations of 35
60-such utility service lines are shown on the above referenced map 36
61-showing the first parcel of land herein described. 37

58+Records. The conveyance of said parcels of land shall include transfer 29

61+line, and utility lines located on Connecticut Light and Power 32
62+Company poles 21, 22, 23 and 24, on terms negotiated by the 33

6267 (b) The town of Mansfield shall use said parcels of land [for a day 38
63-care facility] for municipal purposes and shall compensate the state of 39
64-Connecticut for [such facility's] use of the utilities and services of the 40
65-Mansfield Training School. [If said parcels are not used for such 41
66-purpose, the parcels shall revert to the state of Connecticut.] If the 42
67-town of Mansfield: 43
68-(1) Does not use said parcels for said purposes; 44
69-(2) Does not retain ownership of all of said parcels; or 45
70-(3) Leases all or any portion of said parcels, 46
71-the parcels shall revert to the state of Connecticut. 47
72-(c) The [state properties review board] State Properties Review 48
73-Board shall complete its review of the conveyance of said parcels of 49
74-land not later [that] than thirty days after it receives a proposed 50 Substitute Bill No. 7418
68+care facility] and shall compensate the state of Connecticut for [such 39
69+facility's] use of the utilities and services of the Mansfield Training 40
70+School. [If said parcels are not used for such purpose, the parcels shall 41
71+revert to the state of Connecticut.] 42
72+(c) The [state properties review board] State Properties Review 43
73+Board shall complete its review of the conveyance of said parcels of 44
74+land not later than thirty days after it receives a proposed agreement 45
75+from the [commissioner of mental retardation] Commissioner of 46
76+Developmental Services. The land shall remain under the care and 47
77+control of said commissioner until a conveyance is made in accordance 48 Raised Bill No. 7418

82-Commissioner of Developmental Services. The land shall remain 52
83-under the care and control of said commissioner until a conveyance is 53
84-made in accordance with the provisions of this section. The [state 54
85-treasurer] State Treasurer shall execute and deliver any deed or 55
86-instrument necessary for a conveyance under this section and the 56
87-[commissioner of public works] Commissioner of Administrative 57
88-Services shall have the sole responsibility for all other incidents of such 58
89-conveyance. 59
