19-AN ACT PROHIBITING AN UNAUTHORIZED PELVIC EXAMINATION

2220 Be it enacted by the Senate and House of Representatives in General

25-Section 1. (NEW) (Effective July 1, 2019) (a) No physician licensed 1
26-pursuant to chapter 370 of the general statutes, student in a medical 2
27-school participating in a course of instruction or person participating 3
28-in a residency program or clinical training program may perform a 4
29-pelvic examination on a female patient who is (1) under deep sedation 5
30-or anesthesia, or (2) unconscious unless (A) the patient or, if the patient 6
31-is incapacitated, the legal representative of the patient gave informed 7
32-consent to the pelvic examination, (B) the performance of a pelvic 8
33-examination is within the scope of the surgical procedure or diagnostic 9
34-examination to be performed on the patient, or (C) in the case of an 10
35-unconscious patient, the pelvic examination is required for diagnostic 11
36-purposes. 12
37-(b) The Department of Public Health (1) shall investigate any 13
38-alleged violation of subsection (a) of this section pursuant to 14
39-subdivision (11) of subsection (a) of section 19a-14 of the general 15
40-Committee Bill No. 16

45-statutes, and (2) if the department determines a violation was 16
46-committed, may take disciplinary action under section 19a-17 of the 17
47-general statutes. 18
48-This act shall take effect as follows and shall amend the following
