AN ACT PROHIBITING DISCRETIONARY CLAUSES IN HEALTH INSURANCE AND DISABILITY INCOME POLICIES. Be it enacted by the Senate and House of Representatives in General Assembly convened: That title 38a of the general statutes be amended to prohibit each 1 insurance company, fraternal benefit society, hospital service 2 corporation, medical service corporation and health care center that 3 delivers, issues for delivery or renews an insurance policy in this state 4 from including in such policy a clause that reserves discretion to such 5 company, society, corporation or center to interpret the terms of such 6 policy in a manner that is, or to provide standards for the 7 interpretation or review of such policy that are, inconsistent with the 8 laws of this state. 9 Statement of Purpose: To prohibit each insurance company, fraternal benefit society, hospital service corporation, medical service corporation and health care center that delivers, issues for delivery or renews an insurance policy in this state from including in such policy a clause that reserves discretion to such company, society, corporation or center to interpret the terms of such policy in a manner that is, or to provide standards for the Proposed Bill No. 41 LCO No. 905 2 of 2 interpretation or review of such policy that are, inconsistent with the laws of this state.
