AN ACT CONCERNING THE USE OF EMINENT DOMAIN. Be it enacted by the Senate and House of Representatives in General Assembly convened: That the general statutes be amended to (1) permit certain property 1 owners to repurchase property taken from them by eminent domain if 2 such property is not used for a public use and is subsequently resold; 3 (2) prohibit persons from misrepresenting that they are authorized to 4 acquire property by eminent domain by making such 5 misrepresentation an unfair trade practice; (3) require that appraisals 6 in eminent domain proceedings be conducted by licensed real estate 7 appraisers in accordance with uniform standards; (4) require the 8 consent of the parties before a court may appoint a judge trial referee 9 to review a statement of compensation in an eminent domain 10 proceeding; (5) increase the maximum payments for relocation 11 assistance; and (6) revise the standards used by municipal legislative 12 bodies prior to authorizing the use of eminent domain pursuant to a 13 development plan under chapter 132 of the general statutes. 14 Statement of Purpose: To (1) permit certain property owners to repurchase property taken from them by eminent domain if such property is not used for a public Proposed Bill No. 545 LCO No. 2687 2 of 2 use and is subsequently resold; (2) prohibit persons from misrepresenting that they are authorized to acquire property by eminent domain by making such misrepresentation an unfair trade practice; (3) require that appraisals in eminent domain proceedings be conducted by licensed real estate appraisers in accordance with uniform standards; (4) require the consent of the parties before a court may appoint a judge trial referee to review a statement of compensation in an eminent domain proceeding; (5) increase the maximum payments for relocation assistance; and (6) revise the standards used by municipal legislative bodies prior to authorizing the use of eminent domain pursuant to a development plan under chapter 132 of the general statutes.
