1818 AN ACT LIMITING THE USE OF EMINENT DOMAIN BY
1919 MUNICIPALITIES AND MUNICIPAL DEVELOPMENT AGENCIES AND
2020 ESTABLISHING AN OFFICE OF PROPERTY RIGHTS OMBUDSMAN.
2121 Be it enacted by the Senate and House of Representatives in General
2222 Assembly convened:

2424 That the general statutes be amended to (1) eliminate the use of 1
2525 eminent domain by (A) a municipality or development agency to 2
2626 acquire property within a municipal development project area, and (B) 3
2727 an implementing agency to acquire property in a development plan 4
2828 under the Manufacturing Assistance Act; (2) establish an Office of 5
2929 Property Rights Ombudsman; (3) permit a private property owner to 6
3030 request that the ombudsman arbitrate an eminent domain or relocation 7
3131 assistance dispute between the owner and a public agency; and (4) 8
3232 require a public agency to make a reasonable effort to negotiate with a 9
3333 property owner before starting an eminent domain action and provide 10
3434 the property owner with certain information before filing such an 11
3535 action, including information about the ombudsman. 12
3636 Statement of Purpose:
3737 To (1) eliminate the use of eminent domain by (A) a municipality or
