AN ACT PERMITTING A COMMUNITY SPOUSE OF AN 
INSTITUTIONALIZED SPOUSE TO RETAIN THE MAXIMUM AMOUNT 
OF ALLOWABLE ASSETS. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. (NEW) (Effective from passage) (a) For purposes of this 1 
section: 2 
(1) "Institutionalized spouse" has the same meaning as provided in 42 3 
USC 1396r-5(h)(1). 4 
(2) "Community spouse" has the same meaning as provided in 42 USC 5 
1396r-5(h)(2). 6 
(b) The Commissioner of Social Services shall amend the Medicaid 7 
state plan to permit a community spouse of an institutionalized spouse to 8 
retain the maximum resource amount allowable for such community 9 
spouse pursuant to 42 USC 1396r-5(f)(2). 10 
(c) The commissioner shall adopt regulations, in accordance with the 11 
provisions of chapter 54 of the general statutes, to implement the 12

This act shall take effect as follows and shall amend the following 
sections:

Statement of Purpose:   
To allow spouses of institutionalized Medicaid recipients to retain a 
greater share of marital assets in order to live independently longer in 
the community and save state costs related to institutionalization.
