2019 AN ACT PERMITTING A COMMUNITY SPOUSE OF AN
2120 INSTITUTIONALIZED SPOUSE TO RETAIN THE MAXIMUM AMOUNT

2322 Be it enacted by the Senate and House of Representatives in General

2625 Section 1. (NEW) (Effective from passage) (a) For purposes of this 1

2827 (1) "Institutionalized spouse" has the same meaning as provided in 42 3
2928 USC 1396r-5(h)(1). 4
3029 (2) "Community spouse" has the same meaning as provided in 42 USC 5
3130 1396r-5(h)(2). 6
3231 (b) The Commissioner of Social Services shall amend the Medicaid 7
3332 state plan to permit a community spouse of an institutionalized spouse to 8
3433 retain the maximum resource amount allowable for such community 9
3534 spouse pursuant to 42 USC 1396r-5(f)(2). 10
3635 (c) The commissioner shall adopt regulations, in accordance with the 11
3736 provisions of chapter 54 of the general statutes, to implement the 12
