1818 AN ACT CONCERNING THE SALE AND USE OF CONSUMER GRADE
1919 FIREWORKS.
2020 Be it enacted by the Senate and House of Representatives in General
2121 Assembly convened:

2323 That the general statutes be amended to (1) expand the type of 1
2424 fireworks that may be legally sold and used in this state by allowing 2
2525 the sale and use of all consumer fireworks permitted by federal law; (2) 3
2626 allow any person twenty-one years of age or older to use or explode 4
2727 consumer fireworks from six o'clock p.m. to eleven o'clock p.m. on any 5
2828 day and from eleven o'clock p.m. on New Year's Eve until one o'clock 6
2929 a.m. on New Year's Day; (3) require the Commissioner of Consumer 7
3030 Protection to create a license to sell consumer fireworks and require a 8
3131 seller to obtain such license and a federal fireworks license before 9
3232 selling consumer fireworks; (4) allow licensees to store and sell 10
3333 consumer fireworks only from a permanent facility in accordance with 11
3434 the National Fire Protection Association Section 1124: Code for the 12
3535 Manufacture, Transportation, and Storage of Fireworks and 13
3636 Pyrotechnic Articles, 2006 edition; (5) require a separate license from 14
3737 the Department of Consumer Protection for each location that sells 15
3838 fireworks; (6) require the State Fire Marshal to (A) inspect the premises 16
3939 where fireworks are sold, stored and offered for retail sale to the 17 Proposed Bill No. 664

4444 public, and (B) enforce the age and time of day restrictions on use of 18
4545 fireworks; (7) impose a tax on the initial sale of fireworks in the state at 19
4646 the rate of five per cent of the average wholesale price, with tax 20
4747 revenue deposited into a consumer fireworks account for distribution 21
4848 to the firefighters cancer relief account and the state fire school training 22
4949 and education extension account; (8) provide that an unlicensed seller 23
5050 who offers or exposes for sale, sells at retail or possesses with the 24
5151 intent to sell consumer fireworks commits an unfair trade practice; and 25
5252 (9) provide that a person is guilty of a class C misdemeanor if the 26
5353 person (A) is an unlicensed seller who offers or exposes for sale, sells at 27
5454 retail or possesses with the intent to sell consumer fireworks, or (B) 28
5555 violates the age restrictions on possession of fireworks or the time of 29
5656 day restrictions on use of fireworks. 30
