19 | 19 | | Section 1. (NEW) (Effective July 1, 2019) (a) An employer shall not 1 |
---|
20 | 20 | | enter into or negotiate a contract with an employee or prospective 2 |
---|
21 | 21 | | employee as a condition of employment, continued employment, 3 |
---|
22 | 22 | | promotion, compensation or benefit, if such contract contains a 4 |
---|
23 | 23 | | nondisclosure clause, nondisparagement clause, waiver or other 5 |
---|
24 | 24 | | provision that has the purpose or effect of preventing the employee 6 |
---|
25 | 25 | | from disclosing or discussing sexual harassment or sexual assault 7 |
---|
26 | 26 | | occurring in the workplace, at a work-related event coordinated by or 8 |
---|
27 | 27 | | through the employer or between employees, or between an employer 9 |
---|
28 | 28 | | and an employee, off the employment premises. 10 |
---|
29 | 29 | | (b) An action to redress a violation of subsection (a) of this section 11 |
---|
30 | 30 | | may be maintained in any court of competent jurisdiction by any one 12 |
---|
31 | 31 | | or more employees or prospective employees. 13 |
---|
32 | 32 | | (c) An employer who violates subsection (a) of this section may be 14 |
---|
33 | 33 | | found liable for compensatory damages, attorney's fees and costs, 15 |
---|
34 | 34 | | punitive damages and such legal and equitable relief as the court 16 |
---|
