1414 AN ACT CONCERNING SM OKING AND VAPING ON BEACHES IN
1515 STATE PARKS.
1616 Be it enacted by the Senate and House of Representatives in General
1717 Assembly convened:

1919 Section 1. (NEW) (Effective July 1, 2019) (a) No person shall engage in 1
2020 the act of smoking on any beach located in a state park. 2
2121 (b) The Commissioner of Energy and Environmental Protection may 3
2222 enforce the provisions of this section and issue a warning for any first 4
2323 violation of the provisions of this section and any person who violates 5
2424 the provisions of this section a second or subsequent time shall be 6
2525 deemed to have committed an infraction. Nothing in this section shall 7
2626 be construed to require the alteration of any sign located in a state 8
2727 park. Notice of the prohibition contained in this section shall be posted 9
2828 on the Internet web site of the Department of Energy and 10
2929 Environmental Protection and shall be conveyed by any applicable 11
3030 park attendant to a patron upon such patron's entry to such park. 12
3131 (c) For purposes of this section, "smoking" means inhaling, exhaling, 13
3232 burning, carrying or otherwise possessing any lighted cigarette, cigar, 14
3333 pipe or any other object or device of any form that contains lighted 15
3434 tobacco or any other smoking product including any electronic 16
3535 nicotine delivery system and vapor product. 17
