AN ACT CONCERNING COMPENSATION FOR CERTAIN
PROPERTIES TAKEN BY EMINENT DOMAIN.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
That chapter 238 of the general statutes be amended to require the 1
Commissioner of Transportation to consider the potential value of all 2
permitted uses of a private property being taken for state use under 3
the applicable zoning regulations in calculating the reimbursement for 4
such property and that such calculation shall be retroactive to any 5
properties condemned by the Department of Transportation 6
commencing on July 1, 2018. 7
Statement of Purpose:
To adequately compensate property owners when their land is taken
by eminent domain.
