AN ACT ALLOWING THE CONNECTICUT HEALTH A ND 
EDUCATIONAL FACILITIES AUTHORITY TO MAKE LOANS FOR THE 
COST OF RELATED HEAL TH CARE INSTITUTIONS.  
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. Subsection (b) of section 10a-178 of the general statutes is 1 
repealed and the following is substituted in lieu thereof (Effective July 2 
1, 2019): 3 
(b) "Project", (1) in the case of a participating institution for higher 4 
education, means a structure suitable for use as a dormitory or other 5 
housing facility, including housing for staff members, employees or 6 
students at such institution of higher education, dining hall, student 7 
union, administration building, academic building, library, laboratory, 8 
research facility, classroom, athletic facility, health care facility, and 9 
maintenance, storage or utility facility and other structures or facilities 10 
related thereto or required or useful for the instruction of students or 11 
the conducting of research or the operation of an institution for higher 12 
education, including parking and other facilities or structures essential 13 
or convenient for the orderly conduct of such institution for higher 14 
education, also including equipment and machinery and other similar 15 
items necessary or convenient for the operation of a particular facility 16 
or structure in the manner for which its use is intended or for the 17 
operation of a participating institution for higher education, or any 18  Substitute Bill No. 816

combination thereof, but shall not include such items as books, fuel, 19 
supplies or other items the purchase of which is customarily deemed 20 
to result in a current operating charge; (2) in the case of a participating 21 
health care institution, means a structure suitable for use as a hospital, 22 
clinic, or other health care facility, laboratory, laundry, residence 23 
facility, including housing for nurses, interns, staff members, 24 
employees or students at such health care institution and their 25 
immediate families and for physically or mentally handicapped 26 
persons, administration building, research facility, related health care 27 
institution, as defined in subsection (r) of this section, and 28 
maintenance, storage or utility facility and other structures or facilities 29 
related thereto or required or useful for the operation of the project, 30 
including parking and other facilities or structures essential or 31 
convenient for the orderly operation of such project, also including 32 
equipment and machinery and other similar items necessary or 33 
convenient for the operation of the project in the manner for which its 34 
use is intended or for the operation of a participating health care 35 
institution, or any combination thereof, but shall not include such 36 
items as fuel, supplies or other items the purchase of which is 37 
customarily deemed to result in a current operating charge; (3) in the 38 
case of a participating qualified nonprofit organization, means a 39 
structure or facility owned in its entirety by, or suitable for use in 40 
accordance with the charitable or nonprofit status of the qualified 41 
nonprofit organization, also including equipment and machinery and 42 
other similar items necessary or convenient for the operation of the 43 
project in the manner for which its use is intended or for the operation 44 
of a participating qualified nonprofit corporation; and [,] (4) in the case 45 
of a participating nursing home, means a structure or facility suitable 46 
for use as a nursing home, residential care home, rest home, health 47 
care facility for the handicapped, mental health facility or independent 48 
living facility subject to the licensing requirements of chapter 368v and 49 
appurtenant facilities, equipment and machinery and other similar 50 
items necessary or convenient for the operation of a particular facility 51 
or structure in the manner for which its use is intended or for the 52 
operation of a participating nursing home; 53  Substitute Bill No. 816

Sec. 2. Section 10a-178 of the general statutes is amended by adding 54 
subsection (r) as follows (Effective July 1, 2019): 55 
(NEW) (r) "Related health care institution" means any hospital, 56 
health care institution, institution, as defined in subsection (a) of 57 
section 19a-490, that is constructed or acquired by a nonprofit, 58 
nonstock corporation or any nonprofit, nonstock, nonsectarian health 59 
care center that conducts activities and carries out purposes as 60 
described in subsection (b) of section 38a-176, and (1) is located outside 61 
of the state, (2) is a wholly owned or controlled subsidiary of a health 62 
care institution, as defined in subdivisions (1) and (2) of subsection (g) 63 
of this section, licensed in the state, and (3) would be eligible to be 64 
licensed as an institution under the provisions of sections 19a-490 to 65 
19a-503, inclusive, if it was located in the state. 66 
This act shall take effect as follows and shall amend the following 
sections:
