20-Section 1. Subsection (b) of section 10a-178 of the general statutes is 1
25+Section 1. Subsection (g) of section 10a-178 of the general statutes is 1
2126 repealed and the following is substituted in lieu thereof (Effective July 2

23-(b) "Project", (1) in the case of a participating institution for higher 4
24-education, means a structure suitable for use as a dormitory or other 5
25-housing facility, including housing for staff members, employees or 6
26-students at such institution of higher education, dining hall, student 7
27-union, administration building, academic building, library, laboratory, 8
28-research facility, classroom, athletic facility, health care facility, and 9
29-maintenance, storage or utility facility and other structures or facilities 10
30-related thereto or required or useful for the instruction of students or 11
31-the conducting of research or the operation of an institution for higher 12
32-education, including parking and other facilities or structures essential 13
33-or convenient for the orderly conduct of such institution for higher 14
34-education, also including equipment and machinery and other similar 15
35-items necessary or convenient for the operation of a particular facility 16
36-or structure in the manner for which its use is intended or for the 17
37-operation of a participating institution for higher education, or any 18 Substitute Bill No. 816
28+(g) "Health care institution" means (1) any nonprofit, state-aided 4
29+hospital or other health care institution, including The University of 5
30+Connecticut Health Center, which is entitled, under the laws of the 6
31+state, to receive assistance from the state by means of a grant made 7
32+pursuant to a budgetary appropriation made by the General 8
33+Assembly, (2) any other hospital or other health care institution which 9
34+is licensed, or any nonprofit, nonstock corporation which shall receive 10
35+financing or shall undertake to construct or acquire a project which is 11
36+or will be eligible to be licensed, as an institution under the provisions 12
37+of sections 19a-490 to 19a-503, inclusive, or any nonprofit, nonstock, 13
38+nonsectarian facility which is exempt from taxation under the 14 Raised Bill No. 816

44-combination thereof, but shall not include such items as books, fuel, 19
45-supplies or other items the purchase of which is customarily deemed 20
46-to result in a current operating charge; (2) in the case of a participating 21
47-health care institution, means a structure suitable for use as a hospital, 22
48-clinic, or other health care facility, laboratory, laundry, residence 23
49-facility, including housing for nurses, interns, staff members, 24
50-employees or students at such health care institution and their 25
51-immediate families and for physically or mentally handicapped 26
52-persons, administration building, research facility, related health care 27
53-institution, as defined in subsection (r) of this section, and 28
54-maintenance, storage or utility facility and other structures or facilities 29
55-related thereto or required or useful for the operation of the project, 30
56-including parking and other facilities or structures essential or 31
57-convenient for the orderly operation of such project, also including 32
58-equipment and machinery and other similar items necessary or 33
59-convenient for the operation of the project in the manner for which its 34
60-use is intended or for the operation of a participating health care 35
61-institution, or any combination thereof, but shall not include such 36
62-items as fuel, supplies or other items the purchase of which is 37
63-customarily deemed to result in a current operating charge; (3) in the 38
64-case of a participating qualified nonprofit organization, means a 39
65-structure or facility owned in its entirety by, or suitable for use in 40
66-accordance with the charitable or nonprofit status of the qualified 41
67-nonprofit organization, also including equipment and machinery and 42
68-other similar items necessary or convenient for the operation of the 43
69-project in the manner for which its use is intended or for the operation 44
70-of a participating qualified nonprofit corporation; and [,] (4) in the case 45
71-of a participating nursing home, means a structure or facility suitable 46
72-for use as a nursing home, residential care home, rest home, health 47
73-care facility for the handicapped, mental health facility or independent 48
74-living facility subject to the licensing requirements of chapter 368v and 49
75-appurtenant facilities, equipment and machinery and other similar 50
76-items necessary or convenient for the operation of a particular facility 51
77-or structure in the manner for which its use is intended or for the 52
78-operation of a participating nursing home; 53 Substitute Bill No. 816

85-Sec. 2. Section 10a-178 of the general statutes is amended by adding 54
86-subsection (r) as follows (Effective July 1, 2019): 55
87-(NEW) (r) "Related health care institution" means any hospital, 56
88-health care institution, institution, as defined in subsection (a) of 57
89-section 19a-490, that is constructed or acquired by a nonprofit, 58
90-nonstock corporation or any nonprofit, nonstock, nonsectarian health 59
91-care center that conducts activities and carries out purposes as 60
92-described in subsection (b) of section 38a-176, and (1) is located outside 61
93-of the state, (2) is a wholly owned or controlled subsidiary of a health 62
94-care institution, as defined in subdivisions (1) and (2) of subsection (g) 63
95-of this section, licensed in the state, and (3) would be eligible to be 64
96-licensed as an institution under the provisions of sections 19a-490 to 65
97-19a-503, inclusive, if it was located in the state. 66
44+provisions of section 12-81 or 38a-188 and which is a health care center 15
45+under the provisions of sections 38a-175 to 38a-194, inclusive, [or] (3) 16
46+any nonprofit corporation wholly owned by two or more hospitals or 17
47+other health care institutions which operates for and on behalf of such 18
48+hospitals or other health care institutions a project, as defined in 19
49+subsection (b) of this section, or is a nursing home, or (4) any related 20
50+health care institution, as defined in subsection (r) of this section; 21
51+Sec. 2. Section 10a-178 of the general statutes is amended by adding 22
52+subsection (r) as follows (Effective July 1, 2019): 23
53+(NEW) (r) "Related health care institution" means any hospital or 24
54+health care institution, any nonprofit, nonstock corporation that 25
55+constructs or acquires an institution, as defined in subsection (a) of 26
56+section 19a-490, or any nonprofit, nonstock, nonsectarian health care 27
57+center that conducts activities and carries out purposes as described in 28
58+subsection (b) of section 38a-176, that (1) is located outside of the state, 29
59+(2) is a wholly owned or controlled subsidiary of a health care 30
60+institution, as defined in subdivisions (1) and (2) of subsection (g) of 31
61+this section, licensed in the state, and (3) would be eligible to be 32
62+licensed as an institution under the provisions of sections 19a-490 to 33
