LCO No. 3689 1 of 2 General Assembly Raised Bill No. 819 January Session, 2019 LCO No. 3689 Referred to Committee on HUMAN SERVICES Introduced by: (HS) AN ACT PROHIBITING ASSISTED LIVING SERVICES AGENCIES AN D CONTINUING CARE PROV IDERS OFFERING ASSISTED LIVING SERVICES FROM REQUIR ING A THIRD-PARTY CONTRACT GUARANTOR. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective from passage) No assisted living services 1 agency licensed pursuant to chapter 368v of the general statutes shall 2 require a third-party guarantee of payment in any contract for services 3 entered into after the effective date of this section. If a contract entered 4 into after the effective date of this section contains a provision 5 requiring a third-party guarantee of payment such provision shall be 6 void and unenforceable. The invalidity or unenforceability of any 7 contract provision under this section shall not affect any other 8 provision of the contract. 9 Sec. 2. Section 17b-523 of the general statutes is amended by adding 10 subsection (c) as follows (Effective from passage): 11 (NEW) (c) No provider of continuing care that includes assisted 12 living services shall require a third-party guarantee of payment in any 13 Raised Bill No. 819 LCO No. 3689 2 of 2 continuing care contract for admission or continued residency entered 14 into after the effective date of this section. If a contract entered into 15 after the effective date of this section contains a provision requiring a 16 third-party guarantee of payment such provision shall be void and 17 unenforceable. The invalidity or unenforceability of any contract 18 provision under this subsection shall not affect any other provision of 19 such contract. 20 This act shall take effect as follows and shall amend the following sections: Section 1 from passage New section Sec. 2 from passage 17b-523 Statement of Purpose: To apply to assisted living services agencies and continuing care providers that offer assisted living services the same prohibition on third-party guarantor contract requirements applied to nursing home facilities.
