20	19		AN ACT CONCERNING TH E RECOMMENDATIONS OF T HE
21	20		CONNECTICUT SENTENCI NG COMMISSION WITH R ESPECT TO
22	21		MISDEMEANOR SENTENCE S.
23	22		Be it enacted by the Senate and House of Representatives in General
24	23		Assembly convened:

26	25		Section 1. (NEW) (Effective July 1, 2019) (a) Notwithstanding any 1
27	26		provision of the general statutes, any offense which constitutes a 2
28	27		breach of any law of this state for which a person may be sentenced to 3
29	28		a term of imprisonment of up to but not exceeding one year shall be 4
30	29		punishable by imprisonment for a period not to exceed three hundred 5
31	30		sixty-four days. A misdemeanor conviction for which a person was 6
32	31		sentenced to a term of imprisonment of one year shall continue to be 7
33	32		deemed a misdemeanor conviction after the maximum term of 8
34	33		imprisonment is reduced pursuant to this section. 9
35	34		(b) The provisions of this section apply to any term of imprisonment 10
36	35		for which a person was sentenced to before, on or after July 1, 2019. 11
37	36		(c) Any person sentenced to a term of imprisonment of one year, 12
38	37		prior to July 1, 2019, for any offense previously punishable by a term of 13

	44	+	imprisonment of up to but not exceeding one year, may apply to the 14
46	45		court that entered the judgment of conviction to have the term of 15
47	46		sentence modified to the maximum term of imprisonment for a period 16
48	47		not to exceed three hundred sixty-four days. Any such application 17
49	48		may be filed at any time and the court shall issue such modification 18
50	49		regardless of the date of conviction, provided the record of such 19
51	50		sentence has not been destroyed. 20
