19+AN ACT CONCERNING AM ENDMENTS TO THE METROPOLITAN

1621 Be it enacted by the Senate and House of Representatives in General

1924 Section 1. Section 19 of number 511 of the special acts of 1929 is 1
2025 amended to read as follows (Effective from passage): 2
2126 No bonds, notes or other certificates of debt, except such as are to 3
2227 mature in six months or less and to be paid from current taxes shall be 4
23-issued under authority of [this act] number 511 of the special acts of 5
24-1929 if such issue shall bring the total outstanding indebtedness of the 6
25-district to an amount in excess of five per centum of the combined 7
26-grand lists of said district unless otherwise provided by special act. 8
27-The grand lists for the purpose of this section shall be deemed to 9
28-include the assessed value of all shares of capital stock the taxes on 10
29-which are required by section 1205 of the general statutes, revision of 11
30-1918, as amended to be remitted annually to the towns and cities 12
31-composing the district by the state. In computing the total outstanding 13
32-indebtedness of the district for the purposes of this section, there shall 14
33-be deducted the amount of the district's sinking fund, the amount of 15
34-bonds issued for the supply of water or for the construction of 16
35-subways or underground conduits for cables, wires or pipes, the 17
36-principal amount of all such bonds having been refunded or replaced 18
37-by other indebtedness the proceeds and projected earnings on which 19 Substitute Bill No. 971
28+issued under authority of this act if such issue shall bring the total 5
29+outstanding indebtedness of the district to an amount in excess of five 6
30+per centum of the combined grand lists of said district unless 7
31+otherwise provided by special act. The grand lists for the purpose of 8

33+of capital stock the taxes on which are required by section 1205 of the 10

35+to the towns and cities composing the district by the state. In 12

45-principal, interest and any redemption premium until maturity or 21
46-earlier planned redemption of such indebtedness and the amount of 22
47-such other bonds of the district as may be issued under any act of the 23
48-legislature, especially providing that the bonds issued [thereunder] 24
49-under any such act shall be deducted in computing the total 25
50-outstanding indebtedness of the district. 26

50+indebtedness and the amount of such other bonds of the district as 22
51+may be issued under any act of the legislature, especially providing 23
52+that the bonds issued [thereunder] under any such act shall be 24
53+deducted in computing the total outstanding indebtedness of the 25
54+district. 26
55+Sec. 2. (Effective from passage) In any town or city in which The 27
56+Metropolitan District shall furnish water directly to the inhabitants for 28
57+domestic and other purposes and shall maintain a sanitary sewer 29
58+system, the district board of The Metropolitan District may: (1) 30
59+Develop a program for control and abatement of stormwater pollution 31
60+from existing land uses, and the detection and elimination of 32
61+connections to the stormwater system that threaten the public health or 33
62+welfare or the environment; (2) provide public education and outreach 34
63+relating to stormwater management activities and establish procedures 35
64+for public participation; and (3) provide for the administration of such 36
65+stormwater management program. In accomplishing the purposes of 37
66+this section, such program may plan, layout, acquire, construct, 38
67+reconstruct, maintain, supervise and manage stormwater control 39
68+systems. 40
69+Sec. 3. (Effective from passage) For the purpose of providing adequate 41
70+funding to accomplish the goals of section 2 of this act, the district 42
71+board of The Metropolitan District may, in the event that stormwater is 43
72+discharged to a sanitary sewer system located in a town or city 44
73+described in section 2 of this act, impose a stormwater discharge fee 45
74+upon such town or city. The district board may from time to time 46
75+adopt, alter or repeal ordinances for the determination of the nature 47
76+and amount of such stormwater discharge fee and for the adjustment 48
77+of special cases, by measurement or estimation of stormwater 49 Raised Bill No. 971

83+discharge, where quantity of water used by the inhabitants does not 50
84+properly reflect use of the sanitary sewer system. Such ordinances may 51
85+prescribe the methods of collection, may provide for a penalty and 52
86+may prescribe and limit the purposes for which avails of the 53
87+stormwater discharge fees shall be used. Nothing herein contained 54
88+shall preclude use of other methods of meeting the expense of the 55
89+stormwater management program described in section 2 of this act. 56
