1919 AN ACT CONCERNING MU NICIPAL NOTICE TO SOLID WASTE
2020 COLLECTORS AND CONTI NUANCE OF SERVICE BY SUCH SOLID

2222 Be it enacted by the Senate and House of Representatives in General
2323 Assembly convened:

2525 Section 1. (NEW) (Effective October 1, 2019) (a) In any municipality 1
2626 where a solid waste collector has arrangements, contractual or 2
2727 otherwise, with residents of such municipality for the provision of 3
2828 trash collection and disposal services, the chief executive officer of 4
2929 such municipality shall give notice of not less than sixty days to such 5
3030 solid waste collector in the event such municipality will (1) begin 6
3131 directly providing such trash collection and disposal services to the 7
3232 residents of such municipality, or (2) contract with another solid waste 8
3333 collector for the provision of such services to such residents. 9
3434 (b) For not less than one year after the date on which such notice is 10
3535 given, (1) the municipality shall be prohibited from providing such 11
3636 trash collection and disposal services, (2) any solid waste collector with 12
3737 which such municipality subsequently contracts for the provision of 13

5353 Statement of Purpose:
5454 To require (1) a municipality to give notice of at least sixty days to any
5555 solid waste collector operating in such municipality prior to any action
5656 taken by such municipality to provide its own trash collection and
5757 disposal services, including contracting with another solid waste
5858 collector to provide such service, and (2) that, for one year after any
5959 such action, any solid waste collector with existing arrangements for
6060 the provision of such services be permitted to continue to provide such
6161 service.
